Careful analysis of the views and arguments put forward during the public consultation, and notably of the position of the European Parliament, together with the expertise gathered by the Commission in the course of previous activities in the area of consumer protection and competition, makes it possible to identify the main issues that must be addressed in a coherent manner in a European horizontal framework on collective redress.

This is the reason that in paragraph 1 of its report for 2003, the Parliament expressly stated "Although satisfied with the manner in which the High Representative/Secretary General of the Council has indeed kept Parliament fully informed of progress regarding the main CFSP issues, emphatically rejects the a posteriori approach followed by the Council so far of merely submitting a descriptive list of CFSP activities carried out in the previous year, and considers such a practice as clearly infringing Article 21 of the Treaty on European Union and the Interinstitutional Agreement of 6 May 1999 as far as prior consultation of the European Parliament is concerned; " The Parliament instead requested the Council, ".to discontinue the existing practice and to replace it with an a priori approach whereby Parliament is consulted at the beginning of each year on the main aspects and basic choices envisaged by the Council for that year both on global and horizontal issues, as well as on the priorities planned for the different geographical areas; further asks the Council to subsequently report on whether and, if so, how Parliament's contribution has been taken into account; "

2.17 considering that the proposal to strengthen the current consultative role of the CoR by means of a horizontal clause stipulating that the CoR shall be consulted in areas of shared competence, for measures to coordinate economic and employment policies, and in areas of supporting, coordinating or complementary action was not accepted, the CoR calls on the European Commission to consult in all initiatives in areas of manifest local or regional dimension or competence where no mandatory consultation is provided for in the Treaty.

Calls for a restructuring and rationalisation of budgetary instruments in order to boost the responsiveness and flexibility of the Union's external policy, while maintaining the transparency of the mechanisms employed and without in any way jeopardising fulfilment of the commitments already entered into; restates the need to introduce for this purpose a mechanism for prior consultation of, and control a posteriori by, Parliament, particularly where appropriations are reallocated; welcomes the rationalisation of headings proposed by the Commission and proposes a breakdown of appropriations by thematic headings matching priorities and horizontal political objectives of the Union, accompanied by a geographical structure allowing such appropriations to be mobilised flexibly for a given area; questions the appropriateness of the existing allocation of responsibilities between external relations and development and proposes that it be reviewed;
66. demande à ce que soient opérées une restructuration et une rationalisation des instruments budgétaires afin d'accroître la capacité de réaction et la flexibilité de l'action extérieure de l'Union, tout en préservant la transparence des mécanismes mis en œuvre, sans entraîner une remise en cause de la tenue des engagements déjà pris; réaffirme la nécessité d'instaurer à cet effet un mécanisme de consultation ex ante et de contrôle a posteriori du Parlement européen, notamment pour ce qui est des réallocations; salue les efforts de rationalisation proposés par la Commission au niveau des rubriques et propose une répartition des crédits selon des lignes thématiques correspondant à des priorités et à des objectifs politiques horizontaux de l'Union, assortie d'une structure géographique qui permettrait de mobiliser ces crédits de manière flexible pour une zone donnée; s'interroge sur la pertinence de la répartition actuelle des compétences entre les relations extérieures et le développement et en propose le réexamen;

Thus there is a call for the CoR's current advisory function to be strengthened by the insertion of a horizontal clause laying down that the CoR should be consulted in areas of shared jurisdiction, for measures concerning the coordination of economic and employment policies, and in areas of supporting, coordinating or complementary action.
