As to the second plea, alleging infringement of Article 7(3) of Regulation No 40/94, the Court of First Instance held, in paragraphs 82 to 89 of the judgment under appeal, that the applicant had not established that the mark applied for had acquired distinctive character throughout the Community as a result of the use which had been made of it, within the meaning of that provision, mainly for the following reasons:
