The General Court erred in its judgment in so far as (i) it was inconsistent with previous judgments handed down on the same question (T-332/06 and C-194/09 P); (ii) when applying Article 107(1) TFEU, it confused two criteria, both necessary to prove the existence of aid, inferring that an advantage was conferred on Alcoa from the mere finding that the resources used were of State origin; (iii) it failed to provide an adequate statement of reasons in so far as it failed to observe that the Commission had erred in assuming that Alcoa had obtained an advantage from the measure and had not, therefore, to that end, carried out a proper economic analysis to calculate the extent of the advantage in this particular case.

In that connection the General Court: (1) found, incorrectly, that the fact that the measure which has an adverse effect on the individual members of the applicant association also affects other does not preclude those members from being individually concerned; (2) found, incorrectly, that only the relevant members had claimed to be in competition with the recipients of the aid; and (3) thereby failed, incorrectly, to accord weight to the specific calculations which the appellants had submitted showing that the aid would inevitably have an adverse effect on their market position; and (4) in addition to the error referred to in (1), incorrectly failed to see that the measure having an adverse effect is not the same for all operators; (5) incorrectly assumed that the appellants must provide proof of loss of income which has already occurred in order to have standing to bring proceedings; (6) incorrectly dismissed claims of adverse effect on the basis of other, undocumented causes of the adverse effect; and (7) ruled out the possibility of easing the requirements for having standing on the ground that the Commission’s decision to allow the aid under Article 107(3)(c) had not been dealt with administratively on its merits.

The General Court stated that ‘it is necessary . only to consider whether the applicants have demonstrated, in the present case, the existence of circumstances such as to ensure the incentive effect of the scheme at issue, even where no application had been submitted before work had commenced on the projects in question’, However, it did not state that the applicants had not demonstrated this and nor did it give any reason on the basis of which it would be possible to understand the ground for such a (wholly implicit) belief.
