This means that there is an obligation to take foreign convictions into account, to be exercised in accordance with national law (the only obligation for Member States would be to take into account a foreign conviction to the extent that a national conviction would be taken into account).

3. Member States shall take the necessary measures to ensure that, for the application of paragraphs 1 and 2 of this Article, information concerning the existence of criminal convictions for any of the offences referred to in Articles 3 to 7, or of any disqualification from exercising activities involving direct and regular contacts with children arising from those criminal convictions, is transmitted in accordance with the procedures set out in Council Framework Decision 2009/315/JHA of 26 February 2009 on the organisation and content of the exchange of information extracted from the criminal record between Member States when requested under Article 6 of that Framework Decision with the consent of the person concerned.
3. Les États membres prennent les mesures nécessaires pour que, aux fins des paragraphes 1 et 2 du présent article, les informations relatives à l’existence de condamnations pénales pour toute infraction visée aux articles 3 à 7, ou de toute mesure d’interdiction d’exercer des activités impliquant des contacts directs et réguliers avec des enfants consécutive auxdites condamnations pénales, soient transmises conformément aux procédures énoncées dans la décision-cadre 2009/315/JAI du Conseil du 26 février 2009 concernant l’organisation et le contenu des échanges d’informations extraites du casier judiciaire entre les États membres , lorsque ces informations sont demandées au titre de l’article 6 de ladite décision-cadre avec l’accord de la personne concernée.

2. Member States shall take the necessary measures to ensure that employers, when recruiting a person for professional or organised voluntary activities involving direct and regular contacts with children, are entitled to request information in accordance with national law by way of any appropriate means, such as access upon request or via the person concerned, of the existence of criminal convictions for any of the offences referred to in Articles 3 to 7 entered in the criminal record or of the existence of any disqualification from exercising activities involving direct and regular contacts with children arising from those criminal convictions.

Les États membres prennent les mesures nécessaires pour que les employeurs, lorsqu’ils recrutent une personne pour des activités professionnelles ou des activités bénévoles organisées impliquant des contacts directs et réguliers avec des enfants, aient le droit de demander des informations, conformément au droit national, par tout moyen approprié, tel que l’accès sur demande ou via la personne concernée, relatives à l’existence de condamnations pénales pour toute infraction visée aux articles 3 à 7 inscrite au casier judiciaire, ou à l’existence de toute mesure d’interdiction d’exercer des activités impliquant des contacts directs et réguliers avec des enfants consécutive auxdites condamnations pénales.

That does not mean that disqualification must automatically follow as a consequence of conviction for one of the relevant offences but simply that each Member State must provide for the possibility of preventing the person from exercising a specific activity as one of the penalties available following conviction.

When a person who has been convicted of an offence is deprived of the ability to exercise certain rights (for example the right to work with minors), it is primarily to prevent him or her from re-offending.

La décision-cadre du Conseil relative à la lutte contre l'exploitation sexuelle des enfants et la pédopornographie prévoit quant à elle que les Etats membre doivent prendre les mesures pour s'assurer qu'une personne qui a été condamnée pour une des infractions couvertes par l'instrument, puisse être temporairement ou définitivement interdite d'exercer des activités professionnelles liées à la surveillance des enfants.
