It must be recognized that marriage is not a creation of positive law, rather it comes from the intuitive understanding within our civilization of the natural or moral law, an institution that predates our Canadian society, predates even Christianity itself, one that is defined as one man, one woman to the exclusion of all others.
Il faut reconnaître que le mariage n'est pas une création du droit positif, qu'il procède plutôt de l'appréhension intuitive dans notre civilisation du droit naturel ou moral, étant une institution antérieure à notre société canadienne, antérieure même au christianisme et qui est définie comme l'union d'un homme et d'une femme, à l'exclusion de toutes les autres.
