Definition: The main feature is loss of memory, usually of important recent events, that is not due to organic mental disorder, and is too great to be explained by ordinary forgetfulness or fatigue. The amnesia is usually centred on traumatic events, such as accidents or unexpected bereavements, and is usually partial and selective. Complete and generalized amnesia is rare, and is usually part of a fugue (F44.1). If this is the case, the disorder should be classified as such. The diagnosis should not be made in the presence of organic brain disorders, intoxication, or excessive fatigue.

Definition: A transient disorder that develops in an individual without any other apparent mental disorder in response to exceptional physical and mental stress and that usually subsides within hours or days. Individual vulnerability and coping capacity play a role in the occurrence and severity of acute stress reactions. The symptoms show a typically mixed and changing picture and include an initial state of daze with some constriction of the field of consciousness and narrowing of attention, inability to comprehend stimuli, and disorientation. This state may be followed either by further withdrawal from the surrounding situation (to the extent of a dissociative stupor - F44.2), or by agitation and over-activity (flight reaction or fugue). Autonomic signs of panic anxiety (tachycardia, sweating, flushing) are commonly present. The symptoms usually appear within minutes of the impact of the stressful stimulus or event, and disappear within two to three days (often within hours). Partial or complete amnesia (F44.0) for the episode may be present. What should be understood by the concept of extraordinary circumstances which, according to paragraph 23 of the Wallentin judgment, surround the event ‘unexpected flight safety shortcomings’ as referred to in the aforesaid recital 14 if, in the light of paragraph 22, unexpected flight safety shortcomings cannot themselves constitute extraordinary circumstances but may only produce such circumstances?
Que doit-on entendre par la notion de circonstances extraordinaires qui entourent l’évènement que sont les «défaillances imprévues pouvant affecter la sécurité du vol», mentionnées au considérant 14 précité et qui, selon le point 23 de l’arrêt Wallentin, précité, ne sauraient pas constituer elles-mêmes, en tant que défaillances imprévues pouvant affecter la sécurité du vol, des circonstances extraordinaires, mais sont, au vu du point 22, uniquement susceptibles d’en produire?

It is apparent from paragraph 23 of the Wallentin judgment that a technical problem can be considered to be covered by ‘unexpected flight safety shortcomings’ and is therefore an ‘event’ within the meaning of paragraph 22 of the Wallentin judgment; the circumstances surrounding that event may nevertheless be regarded as extraordinary if they relate to an event which is not inherent in the normal exercise of the activities of the air carrier and beyond the actual control of that carrier on account of its nature or origin, as provided in paragraph 23 of the Wallentin judgment; according to paragraph 24 thereof, the resolution of a technical problem which can be traced back to poor maintenance of an aircraft is inherent in the normal exercise of an air carrier’s activity; therefore, according to paragraph 25 of the Wallentin judgment, such technical problems cannot constitute extraordinary circumstances.

If question 6 is answered to the effect that technical problems which are considered to be unexpected flight safety shortcomings constitute extraordinary circumstances which may justify invoking Article 5(3) of the Regulation if they arise from an event which is not inherent in the exercise of the activities of the airline and is beyond the actual control of the latter, does that then mean that a technical problem which arose spontaneously and is not attributable to poor maintenance and was moreover not detected during routine maintenance checks (the said A-D Checks and the Daily Control .) can or cannot constitute an extraordinary circumstance — on the assumption that it could not be detected during the regular maintenance operations — because then no event as referred to in paragraph 26 can be identified and it is therefore also not possible to determine whether such an event is inherent in the exercise of the activities of the airline and is thus beyond the control of the air carrier?
S’il est répondu à la question 6 en ce sens que des problèmes techniques qui peuvent être comptés parmi les défaillances imprévues pouvant affecter la sécurité du vol constituent des circonstances extraordinaires susceptibles de donner lieu à la prise en compte d’un recours à l’article 5, paragraphe 3, du règlement, si elles découlent d’un évènement qui n’est pas inhérent à l’exercice de l’activité du transporteur aérien et si elles échappent à la maîtrise effective de celui-ci, cela signifie-t-il qu’un problème technique survenu spontanément, qui n’est pas imputable à un entretien défectueux et qui n’a pas non plus été décelé lors d’un entretien régulier (lesdits checks A-D et le Daily Control précité sous les faits) peut constituer ou non une circonstance extraordinaire — à supposer qu’il ne pouvait pas être décelé durant ces révisions régulières — puisqu’aucun évènement visé au point 26 ne peut être identifié et qu’il n’est dès lors pas non plus possible de déterminer si celui-ci est inhérent à l’exercice de l’activité de transport aérien et s’il échappe dès lors à la maîtrise du transporteur aérien?

If question 6 is answered to the effect that technical problems which are considered to be unexpected flight safety shortcomings are events as referred to in paragraph 22 and the technical problem arose spontaneously and is not attributable to poor maintenance and was moreover not detected during routine maintenance checks (the said A-D Checks and the Daily Control), is that technical problem inherent or not inherent in the exercise of the activities of the airline and is it or is it not thus beyond the actual control of the airline within the meaning of the aforementioned paragraph 26?
S’il est répondu à la question 6 en ce sens que des problèmes techniques qui peuvent être comptés parmi les défaillances imprévues pouvant affecter la sécurité du vol sont des évènements tels que visés au point 22 et si le problème technique est survenu spontanément et n’est pas imputable à un entretien défectueux et n’a pas non plus été décelé lors d’un entretien régulier (lesdits checks A à D ainsi que le Daily Control), ce problème technique est-il inhérent ou non à l’exercice de l’activité du transporteur aérien et peut-il ou non être maîtrisé par celui-ci au sens du point 26 précité?

It appears to follow from those paragraphs that a technical problem which is covered by ‘unexpected flight safety shortcomings’ is simultaneously an event which may be surrounded by extraordinary circumstances and may itself constitute an extraordinary circumstance.
Il semble ressortir de ces points qu’un problème technique qui relève de «défaillances imprévues pouvant affecter la sécurité du vol» est en même temps un évènement qui peut s’accompagner de circonstances extraordinaires, et même constituer une circonstance extraordinaire.

On the basis of the information received, it shall also ensure that passengers present at the airport are informed about the causes and their rights in cases of delays and flight disruptions, such as the cancellation of their flight, and about their rights in the event that the airline unexpectedly ceases operations, for example in the event of its insolvency or revocation of its operating licence.
