In the context of the first ground of appeal, concerning non-observance of the rules on the representation of the European Union before its judicial bodies , the CJEU submits that, in view of the fact that there is no express rule governing representation of the European Union before its judicial bodies in actions brought pursuant to Article 268 TFEU with a view to engaging the non-contractual liability of the European Union, the rules governing such representation must be derived from the general principles applicable to the exercise of the judicial function, in particular the principle of the sound administration of justice and the principles relating to judicial independence and impartiality.
Dans le cadre du premier moyen, tiré de la méconnaissance des règles relatives à la représentation de l’Union devant ses juridictions , la CJUE relève que, à défaut de disposition expresse organisant la représentation de l’Union devant les juridictions de celle-ci dans le cadre d’actions introduites en vertu de l’article 268 TFUE afin de faire valoir la responsabilité non contractuelle de l’Union, les règles relatives à une telle représentation doivent être déduites de principes généraux présidant à l’exercice de la fonction juridictionnelle, en particulier le principe de bonne administration de la justice ainsi que les principes d’indépendance et d’impartialité du juge.

The review shall concern the questions whether – having regard to the case-law of the Court of Justice relating to the entitlement to paid annual leave as a principle of European Union social law, which is also expressly affirmed in Article 31(2) of the Charter of Fundamental Rights of the European Union and is covered in particular by Directive 2003/88/EC of the European Parliament and of the Council of 4 November 2003 concerning certain aspects of the organisation of working time (OJ 2003 L 299, p. 9) – the judgment of the General Court of the European Union of 8 November 2012 in Case T 268/11 P Commission v Strack affects the unity or consistency of European Union law inasmuch as the General Court, as an appeal court:
Le réexamen portera sur les questions de savoir si, eu égard à la jurisprudence de la Cour afférente au droit au congé annuel payé en tant que principe du droit social de l’Union, également expressément consacré à l’article 31, paragraphe 2, de la charte des droits fondamentaux de l’Union européenne et notamment visé par la directive 2003/88/CE du Parlement européen et du Conseil, du 4 novembre 2003, concernant certains aspects de l’aménagement du temps de travail (1), l’arrêt du Tribunal de l’Union européenne du 8 novembre 2012, Commission/Strack (T-268/11 P), porte atteinte à l’unité ou à la cohérence du droit de l’Union en ce que ledit Tribunal, en tant que juridiction de pourvoi, a interprété:
