6. Article 4 shall not apply to the ERDF part of the envelope allocated to Mayotte as an outermost region within the meaning of Article 349 TFEU, and at least 50 % of that ERDF part shall be allocated to the thematic objectives set out in points 1, 2, 3, 4 and 6 of the first paragraph of Article 9 of Regulation (EU) No 1303 /2013.

In order to facilitate and to promote focused and rapid infrastructural development of Mayotte, it should be possible on an exceptional basis that at least 50 % of the ERDF part of Mayotte's envelope be allocated to five of the thematic objectives laid down in Regulation (EU) No 1303/2013.
Afin de faciliter et de promouvoir un développement rapide et ciblé des infrastructures de Mayotte, il devrait être possible, à titre exceptionnel, d'allouer au moins 50 % de la part FEDER de l'enveloppe de Mayotte à cinq objectifs thématiques énoncés dans le règlement (UE) no 1303/2013.

4b. The ERDF part of the special allocation for the outermost region of Mayotte shall not be subject to Article 4 of this Regulation, and at least 50% shall be allocated to the thematic objectives set out in points 1, 2, 3, 4 and 6 of Article 9 of Regulation (EU) No [... ]/2013 [CPR].

Supports the Commission’s proposal to leave the ESF as part of the Cohesion Policy; considers that better coordination and greater flexibility between the various structural funds should be achieved and that the synergies between the ESF and the ERDF, in particular, should be improved, especially for the sake of the implementation of complex programmes combating exclusion of the most disadvantaged social groups; calls therefore for an improvement of the rules on the provision of funding under the ESF and the ERDF and calls on the Commission to continue the existing possibilities of employing cross-financing arrangements; recalls that better coordination with the EAFRD and the EU horizontal programmes, such as CIP, 7FP, etc ., is also important , especially in the areas of training and qualifications;

According to the information given by the Managing Authority of Berlin, ERDF funds in the form of a grant were allocated to the Bund-Länder-Gemeinschaftsaufgabe “Verbesserung der regionalen Wirtschaftsstruktur” to the company O [amp] K Orenstein [amp] Koppel (grant letter of 16 May 2000, total contribution: 3,06 Million DM / €1,56 Million, ERDF part: 1,52 Million DM / €782.000) (In September 2003 the former O [amp] K Orenstein [amp] Koppel AG has been transformed into CNH Baumaschinen GmbH.)

The problems encountered involve non-compliance with the rules on commitments and the declaration of ineligible expenditure for ERDF part-funding (simple repair or maintenance work, the purchase of a utility vehicle, rental cases where rent payments paid after the measure was completed were treated as eligible, uncertainty as to whether environmental goals were achieved) and the holding back of 4% of the payments from the ERDF (not in conformity with Article 21 of Regulation (EEC) No 4253/88).
