IN-CONTEXT TRANSLATIONS

1. Without prejudice to the provisions of Article 25 of this Convention and subject to paragraph 2 below, the limits of liability prescribed in Articles 21, 22 and 23 shall be reviewed by the Depositary at five-year intervals, the first such review to take place at the end of the fifth year following the date of entry into force of this Convention, or if the Convention does not enter into force within five years of the date it is first open for signature, within the first year of its entry into force, by reference to an inflation factor which corresponds to the accumulated rate of inflation since the previous revision or in the first instance since the date of entry into force of the Convention.

(b) the amount of any benefit which has been determined before the entry into force of this Agreement shall be recalculated and paid with effect from the date of entry into force of this Agreement, provided that the request is submitted within two years from the date of entry into force of this Agreement.

2. If, after the date of entry into force of the previous Agreement but before the date of entry into force of this Agreement, a person submits an application for a benefit under the legislation of a Party, and if, on the date of entry into force of this Agreement, the competent institution of that Party has not yet reached a decision on that application, that competent institution shall apply the provisions of the previous Agreement when determining that person’s entitlement to that benefit.
2. Si, après l’entrée en vigueur de l’ancien Accord, mais avant l’entrée en vigueur du présent Accord, une personne a présenté une demande de prestation aux termes de la législation d’une Partie, et que, au jour de l’entrée en vigueur du présent Accord, l’institution compétente de ladite Partie n’a pas statué sur la demande, l’institution compétente applique les dispositions de l’ancien Accord afin de déterminer le droit de ladite personne à ladite prestation.

(2) (a) Where, prior to the entry into force of this Agreement, a worker other than a worker referred to in Article VI, who is subject to the legislation of one Party and who is employed by an employer having his place of business in the territory of that Party has been sent by that employer to work in the territory of the other Party, he shall after the entry into force of this Agreement be entitled to choose within three months of such entry into force that the legislation of one Party or the other shall apply to him in respect of such employement; and if he chooses to be covered under the legislation of the first Party, then the legislation of that Party shall apply to him for a period of up to 24 months; and if he chooses to be covered under the legislation of the second Party, then the legislation of that Party shall apply to him; and in either case his choice shall take effect from the day on which he gives notice to the appropriate competent authority.
(2) a) Lorsque, avant l’entrée en vigueur du présent Accord, un travailleur, autre que le travailleur décrit à l’Article VI, assujetti à la législation d’une Partie et au service d’un employeur ayant sa place d’affaires sur le territoire de ladite Partie, a été détaché par ledit employeur sur le territoire de l’autre Partie pour y travailler, il pourra, dans les trois mois suivant l’entrée en vigueur du présent Accord, décider si c’est la législation de la première ou de la seconde Partie qui doit lui être appliquée relativement à cette relation de travail; s’il décide d’être assujetti à la législation de la première Partie, la législation de ladite Partie lui sera appliquée pendant une période maximale de 24 mois. S’il décide d’être assujetti à la législation de la seconde Partie, la législation de ladite Partie lui sera appliquée. Dans l’un et l’autre cas, son choix sera exécutoire à compter du jour où il en donnera avis à l’autorité compétente appropriée.

3. During the initial transitional period of seven years, starting from the date of the entry into force of this Agreement, the contribution by each Contracting Member State having ratified or acceded to the Agreement before the entry into force thereof shall be calculated on the basis of the number of European patents having effect in the territory of that State on the date of entry into force of this Agreement and the number of European patents with respect to which actions for infringement or for revocation have been brought before the national courts of that State in the three years preceding entry into force of this Agreement.
3. As a transitional measure, and with respect to acts of the Union in the field of police cooperation and judicial cooperation in criminal matters which have been adopted before the entry into force of the Treaty of Lisbon, the powers of the institutions shall be the following at the date of entry into force of that Treaty: the powers of the Commission under Article 258 of the Treaty on the Functioning of the European Union shall not be applicable and the powers of the Court of Justice of the European Union under Title VI of the Treaty on European Union, in the version in force before the entry into force of the Treaty of Lisbon, shall remain the same, including where they have been accepted under Article 35(2) of the said Treaty on European Union.

In the event that, pending the completion of the procedures necessary for the entry into force of this Agreement, the provisions of certain parts of this Agreement, in particular those relating to the free movement of goods, are put into effect by means of an Interim Agreement between the Community and Lebanon, the parties agree that, in such circumstances, for the purposes of Titles II and IV of this Agreement and Annexes 1 and 2 and Protocols 1 to 5 thereto, the terms ‘date of entry into force of this Agreement’ mean the date of entry into force of the Interim Agreement in relation to obligations contained in these Articles, Annexes and Protocols.
