Her application was rejected in 2005 by the Council for the Recognition of the Equivalence of Higher Education Diplomas (Symvoulio Anagnorisis Epangelmatikis Isotimias Titlon Tritovathmias Ekpaidefsis), because she was not a full member of the Engineering Council and consequently did not hold the title of Chartered Engineer.
Sa demande a été rejetée en 2005 par le Conseil chargé de la reconnaissance de l’équivalence professionnelle des titres d’études supérieures, au motif qu'elle n'était pas membre à part entière de l’Engineering Council et ne possédait par conséquent pas le titre de « Chartered Engineer ».

Mme Toki brought an action against that decision before the Symvoulio tis Epikrateias (Greece), and that court seeks from the Court of Justice clarification of the conditions established by the general system for the recognition of higher education diplomas where a profession is regulated by a private organisation such as the Engineering Council and where the applicant for recognition is not a full member of such an organisation.
Mme Toki a attaqué cette décision devant le Conseil d'État (Grèce), qui demande à la Cour de justice de préciser les conditions établies par le système général de reconnaissance des diplômes lorsqu’il s'agit d'une profession réglementée par une organisation privée telle que l’Engineering Council, et que le demandeur n’en est pas membre à part entière.
