Following disclosure, TK Corporation submitted that the Commission should have based its dumping analysis on the Union export sales of the company, for the following reasons: (i) its export sales to the Union during the RIP were significant and therefore representative, as they consisted of ‘no less than 26 invoices with 282 individual transactions, despite duties being in place’; (ii) in the absence of clarity as concerns anti-dumping duty payment, some of the sales (destined for an offshore project) would not be subject to the anti-dumping duty, whereas for other sales that occurred during the RIP, anti-dumping duties were not always paid by importers as a result of misclassification of those products due to which the importers did not realise that anti-dumping duties were payable.

In view of the conclusions reached with regard to dumping, injury, causation and Union interest, and in accordance with Article 9 of the basic Regulation, it is considered that a definitive anti-dumping duty should be imposed on imports of the product concerned originating in the PRC and Thailand at the level of the lowest of the dumping and injury margins found, in accordance with the lesser duty rule, which is in all, but one, cases the dumping margin.

(Return tabled) Question No. 566 Mr. Mark Holland: With regard to GRK Fasteners: (a) on what grounds are duties, under the Special Import Measures Act (SIMA), applied; (b) on what grounds was their petition to the Canadian International Trade Tribunal (CITT) for a SIMA exempt status denied; (c) given that GRK’s request for exemption is based on the fact that all of their products are patented, is the CITT no longer recognizing that patents make a product unique; (d) was the fact that there are no domestic manufacturers able to provide GRK with the type of product they require taken into account when the CITT made their decision and, if so, why is the SIMA duty still imposed on them and, if not, why not; and (e) does the Canada Border Services Agency or any other department or agency have reason to believe that GRK Fasteners has ever engaged in product dumping and, if so, what evidence do they possess and, if not, how then can an anti-dumping duty be applied to GRK?

On 22 January 2001 the Council imposed, by Regulation (EC) No 132/2001 of 22 January 2001 imposing a definitive anti-dumping duty and collecting definitively the provisional duty imposed on imports of ammonium nitrate originating in Poland and Ukraine, and terminating the anti-dumping proceeding in respect of imports originating in Lithuania (2), a definitive anti-dumping duty of EUR 33,25 per tonne on imports of ammonium nitrate falling within CN codes 3102 30 90 and 3102 40 90 and originating, inter alia, in Ukraine.

The key changes in this bill include: rationalizing the investigative functions of Revenue Canada and the Canadian International Trade Tribunal; enhancing procedural fairness and transparency by harmonizing the way in which Revenue Canada and the tribunal treat the disclosure of confidential information; establishing new penalty provisions to deter any unauthorized disclosure or misuse of confidential information provided in the context of SIMA investigations; allowing expert witnesses to play a much more effective role in tribunal inquiries; improving the provisions that allow for the Deputy Minister of National Revenue to accept an undertaking from exporters to raise prices as an alternative to the imposition of anti-dumping duties; requiring the tribunal to cumulate the injurious effects of dumping or subsidizing from more than one country; and clarifying the conditions under which the tribunal can consider issues of a broader public interest and the very nature of the recommendations the tribunal may make.
