Elle a fait l'objet de nombreuses réunions publiques d'un bout à l'autre du pays, de plusieurs sondages, de 60 000 pétitions présentées aux deux Chambres du Parlement, de deux motions à l'autre endroit, d'une interpellation au Sénat, de deux renvois au Comité sénatorial permanent des affaires sociales, des sciences et de la technologie et, aussi incroyable soit-il, de sept différents projets de loi, dont deux d'initiative parlementaire que j'ai moi-même présentés ici au Sénat, deux présentés à l'autre endroit par le député de Dufferin—Peel—Wellington—Grey et deux présentés par le député d'Ottawa-Centre.

The prevailing view, I think, is that the liberalisation of the internal market in electricity and natural gas is: one, way behind schedule and is being systematically obstructed by monopoly interests on the part of the private sector, the trades union and the national governments, and not just in France; two, that there are huge differences from one country to another. For example, Great Britain has fully liberalised, while France is doing exactly the opposite and the same applies, unfortunately, to my own country; three, as a result of the foregoing, there are serious disruptions in the working of the internal market, competition is being distorted and, consequently, prices are being squeezed at the expense of competitiveness both in the energy production sector and between European companies and in the consumer sector and, four, this delay is hampering cross-border transactions on these markets.
Selon un constat que j’estime général, premièrement, l’ouverture du marché intérieur de l’électricité et du gaz naturel accuse un grave retard et est systématiquement entravée par d’énormes intérêts monopolistiques, privés, syndicaux et étatiques, et pas seulement en France ; deuxièmement, l’on observe de très grandes différences d’un pays à l’autre, la Grande-Bretagne ayant procédé, par exemple, à une libéralisation complète alors que la France fait l’inverse et que c’est malheureusement aussi le cas de mon pays, la Grèce ; troisièmement, il s’ensuit que l’on constate de graves dysfonctionnements du marché intérieur et que la concurrence est contrariée, tout comme l’est, par conséquent, la réduction des prix au profit de la compétitivité tant dans le domaine de la production d’énergie que dans celui des entreprises et de la consommation ; quatrièmement, ce retard entrave le fonctionnement transfrontalier de ces marchés.

(40) Both existing and emerging disparities in Member States' legislation and case-law concerning liability of service providers acting as intermediaries prevent the smooth functioning of the internal market, in particular by impairing the development of cross-border services and producing distortions of competition; service providers have a duty to act, under certain circumstances, with a view to preventing or stopping illegal activities; this Directive should constitute the appropriate basis for the development of rapid and reliable procedures for removing and disabling access to illegal information; such mechanisms could be developed on the basis of voluntary agreements between all parties concerned and should be encouraged by Member States; it is in the interest of all parties involved in the provision of information society services to adopt and implement such procedures; the provisions of this Directive relating to liability should not preclude the development and effective operation, by the different interested parties, of technical systems of protection and identification and of technical surveillance instruments made possible by digital technology within the limits laid down by Directives 95/46/EC and 97/66/EC.
(40) Les divergences existantes et émergentes entre les législations et les jurisprudences des États membres dans le domaine de la responsabilité des prestataires de services agissant en qualité d'intermédiaires empêchent le bon fonctionnement du marché intérieur, en particulier en gênant le développement des services transfrontaliers et en produisant des distorsions de concurrence. Les prestataires des services ont, dans certains cas, le devoir d'agir pour éviter les activités illégales ou pour y mettre fin. La présente directive doit constituer la base adéquate pour l'élaboration de mécanismes rapides et fiables permettant de retirer les informations illicites et de rendre l'accès à celles-ci impossible. Il conviendrait que de tels mécanismes soient élaborés sur la base d'accords volontaires négociés entre toutes les parties concernées et qu'ils soient encouragés par les États membres. Il est dans l'intérêt de toutes les parties qui participent à la fourniture de services de la société de l'information d'adopter et d'appliquer de tels mécanismes. They have a robust technological response to expanses of border between border crossings, and we are very interested in some of the work they are doing technologically to watch the borders without the need to have people standing shoulder to shoulder between the different border points.

Conclusions At the end of this first evaluation and analysis exercise concerning resources for the monitoring of the fishing industry, the Commission takes the view that it must in future give priority to the following: - validation of the information transmitted by each Member State on resources devoted to control work and the outcome of this work; - new areas being covered by control work at Community level (in particular structural policy, market monitoring, possibility of checks during transport, and the development of systematic cross-checks between different sources of information); - the problems in each fishery that lie behind major infringements of Community regulations to the possible detriment of other Member States (e.g. quota overruns in the North and Baltic Seas and disregard of technical conservation rules in Region 3); - coordination between national administrations and between them and the Commission departments, particularly through accelerated implementation of new technology (satellite monitoring, computer links, etc.), plus coordination of action at sea (e.g. in the Atlantic tuna fisheries, checks on catches by vessels operating in the EEZ of one Member State and landing at a port in another,etc.) To sum up, the report stresses the role to be played by the Commission in the process of coordination in order to improve synergy and dispel suspicion between the various interests involved.
Conclusions. Au terme de ce premier exercice d'évaluation et d'analyse des moyens de contrôle pour le secteur de la pêche, pour sa part, la Commission considère qu'elle doit dorénavant accorder la priorité : - à la validation des informations transmises par chaque Etat membre sous forme d'indicateur de moyens et de bilan du contrôle; - à la prise en compte du contrôle des domaines nouvellement intégrés au contrôle de la pêche à l'échelle communautaire (notamment : politique des structures, suivi des marchés, possibilité de contrôle durant le transport, développement des possibilités de contrôle croisé systématique des différentes sources d'information). - aux problèmes qui, dans chaque pêcherie, ont constitué une source d'infractions majeures aux règlements communautaires et de nature à léser d'autres Etats membres, (par exemple: les dépassements de quotas dans la mer du Nord ou dans la Baltique et la négligence des mesures techniques dans la Région 3); - à la coordination entre les administrations nationales chargées du contrôle , d'une part et d'autre part, entre ces administrations et les services de la Commission, notamment par l'accélération de la mise en oeuvre des techniques nouvelles (contrôle par satellite, réseaux informatiques,...), mais également par le renforcement de la coordination des interventions en mer (par exemple: pêcheries atlantiques de thonidés, contrôle des captures des bateaux qui opèrent dans la ZEE d'un Etat membre et débarquent dans un port d'un autre Etat membre, ...).. D'une façon générale, ce rapport renforce le rôle important à jouer par la Commission dans le processus de coordination afin de favoriser les synergies et de dissiper les suspicions entre les différents acteurs.
