In today’s judgment, the Court, after having recalled the procedure laid down by the directive for the entry of a site in the list of SCIs , finds that, although there is no provision which expressly provides for the declassification of a site on the list of SCIs, the directive allows the declassification of an SAC where this is warranted by natural developments in the area.
Dans son arrêt d’aujourd’hui, la Cour, après avoir rappelé la procédure prévue par la directive pour l’inscription d’un site sur la liste des SIC , constate que, même si aucune disposition ne prévoit expressément le déclassement d’un SIC, la directive permet le déclassement d’une ZSC lorsque cela est justifié par l’évolution naturelle de la zone.
