The positive result of the work of that group of experts and the necessity of further enhancing the cooperation and the transparency of the central SIS II project justify the formal integration of the group of experts into the SIS II management structure. A group of experts, called the Global Programme Management Board, should therefore be formally established to complement the current SIS II organisational structure.

2. When the quantities of petroleum products refined in the Netherlands Antilles imported either directly or through another Member State, under the system provided for in Article 2 above, into a Member State or States of the European Union exceed during a calendar year the tonnage shown in the Annex to this Protocol, the measures taken in pursuance of paragraph 1 by that or those Member States for the current year shall be considered to be justified; the Commission shall, after assuring itself that the tonnage fixed has been reached, formally record the measures taken. In such a case the other Member States shall abstain from formally placing the matter before the Council.

For that reason, a fundamental decision of this kind should not be taken by means of a comitology procedure, but rather through the formal codecision procedure involving Parliament and the Council, as currently provided for in the sectoral guidelines in force.
Aussi une telle décision de principe ne devrait-elle pas pouvoir être prise au moyen d'une procédure de comitologie, mais seulement au moyen de la procédure de codécision formelle, par le Parlement européen et le Conseil, comme il est également prévu actuellement dans les directives sectorielles en vigueur.
