2. By way of derogation from paragraph 1, if, when awarding or reviewing benefits in respect of invalidity benefits, old-age and survivors’ pensions pursuant to Chapter 4 and 5 of Title III of the basic Regulation, the institution of a Member State has paid to a person benefits of undue sum, that institution may request the institution of any other Member State responsible for the payment of corresponding benefits to the person concerned to deduct the amount overpaid from the arrears payable to the person concerned.
2. Par dérogation au paragraphe 1, si, lors de la liquidation ou de la révision de prestations d’invalidité ou de pensions de vieillesse ou de survivant en application du titre III, chapitres 4 et 5, du règlement de base, l’institution d’un État membre a versé à une personne des prestations indues, cette institution peut demander à l’institution de tout autre État membre débitrice de prestations correspondantes en faveur de la personne concernée de retenir le montant payé en trop sur les arriérés que celle-ci verse à ladite personne.

The institution identified as being competent for paying the benefits shall deduct the amount due in respect of the provisional payment from the arrears of the corresponding benefits it owes to the person concerned and shall without delay transfer the amount deducted to the institution which provisionally paid the cash benefits.

If, after the entry into force of this Agreement, a person files a written application for benefits with the agency of a Contracting State under the legislation of that Contracting State, and if that person has not explicitly requested that the application be restricted to benefits under that legislation, the application shall also protect the rights of that person to corresponding benefits under the legislation of the other Contracting State, provided that the person at the time of application:
Si, après l’entrée en vigueur du présent Accord, une personne présente une demande écrite de prestations à l’agence d’un État contractant aux termes de la législation dudit État contractant, et si ladite personne n’a pas demandé expressément que la demande soit limitée aux prestations prévues aux termes de ladite législation, la demande protégera également les droits de ladite personne aux prestations correspondantes prévues par la législation de l’autre État contractant, pourvu que ladite personne, au moment de la demande :

The Commission shall also regularly assess whether developments within the framework of the UNFCCC give rise to a situation where the obligations pursuant to this Regulation are no longer necessary, not proportionate to the corresponding benefits, need adjusting or are not consistent with, or are duplicative of, reporting requirements under the UNFCCC, and shall submit, if appropriate, a legislative proposal to the European Parliament and to the Council.
