Any judgment given by a court of one Contracting State for the payment of a sum of money which could be registered under this Convention, whether or not the judgment has been registered, and any other judgment given by such a court, which if it were a judgment for the payment of a sum of money could be registered under this Convention, shall, unless registration has been or would be refused or set aside on any ground other than that the judgment has been satisfied or could not be enforced in the territory of origin, be recognised in a court of the other Contracting State as conclusive between the parties thereto in all proceedings founded on the same cause of action.

In any case, I should like to stress that it is essential to ensure that the list of unfair contract terms not be exhaustive, meaning that each Member State could increase the number of clauses that it considers unacceptable and invalid in contracts with consumers; that the burden of proof be reversed so that it becomes the trader that has to demonstrate that terms outside the norm have been negotiated individually; and that contract terms be expressed in a clear and comprehensible way.

CONVENTION ON INSOLVENCY PROCEEDINGS The Council - noted the agreement of fourteen delegations on the current draft text of the Convention; - instructed the Permanent Representatives Committee to continue its proceedings and seek bases for rapprochement such that unanimous agreement could be reached and to prepare the explanatory report awaited for final approval by the Council. The draft Convention is based on the principle of attenuated universality, i.e. on an approach based on main insolvency proceedings opened in the Contracting State in which a debtor has the centre of his main interests and the possibility of opening secondary or territorial proceedings wherever he is established. The main proceedings would produce effects in all the Contracting States and the territorial and secondary proceedings would produce effects restricted to the territory of the Contracting State where they were opened. This approach represents a compromise which endeavours to take into account the various legal traditions in the Member States.

CONVENTION RELATIVE AUX PROCEDURES D'INSOLVABILITE Le Conseil a - constaté l'accord de quatorze délégations sur l'actuel projet de texte de la Convention ; - donné mandat au Comité des Représentants permanents de poursuivre les travaux en s'efforçant de rechercher des bases de rapprochement permettant à dégager un accord unanime ainsi que pour préparer le rapport explicatif attendu pour l'approbation finale par le Conseil. Le projet de convention est basé sur le principe de l'universalité atténuée, c'est-à-dire sur une approche fondée sur une procédure principale d'insolvabilité ouverte dans l'Etat contractant où le débiteur a le centre de ses intérêts principaux et la possibilité d'ouvrir des procédures secondaires ou territoriales là où le débiteur a un établissement. La procédure principale aurait des effets dans tous les Etats contractants et les procédures territoriales et secondaires auraient des effets limités au territoire de l'Etat contractant où elles seraient ouvertes.
