Moreover, according to the case-law, although Member States have wide discretion to define what they regard as services of general economic interest, the definition of such services or tasks by a Member State can be questioned by the Commission in the event of a manifest error . In other words, although the determination of the nature and scope of an SGEI mission falls within the competence and discretionary powers of Member States, such competence is neither unlimited nor can it be exercised arbitrarily . In particular, for an activity to be considered as an SGEI, it should exhibit special characteristics as compared with ordinary economic activities . In this respect, the Commission will consider that in areas where private investors have already invested in a broadband network infrastructure (or are in the process of expanding further their network infrastructure) and are already providing competitive broadband services with an adequate broadband coverage, setting up a parallel competitive and publicly-funded broadband infrastructure should not be considered as an SGEI within the meaning of Article 86 of the Treaty . Where however it can be demonstrated that private investors may not be in a position to provide in the near future adequate broadband coverage to all citizens or users leaving thus a significant part of the population unconnected, a public service compensation may be granted to an undertaking entrusted with the operation of an SGEI provided that the conditions set out in paragraphs 25 to 29 are met.
En outre, comme l'établit la jurisprudence, même si les États membres disposent d'un large pouvoir d'appréciation pour définir ce qu'ils qualifient de service d'intérêt économique général, la définition de tels services ou missions par un État membre peut être remise en question par la Commission en cas d'erreur manifeste En d'autres termes, même si la détermination de la nature et de la portée d'une mission de SIEG relève de la compétence et des pouvoirs d'appréciation des États membres, cette compétence n'est pas illimitée ni ne saurait être exercée de manière arbitraire En particulier, pour qu'une activité puisse être considérée comme un SIEG, elle devrait présenter certaines caractéristiques spécifiques par rapport à des activités économiques ordinaires À cet égard, la Commission considérera que dans les zones où les investisseurs privés ont déjà investi dans une infrastructure de réseau haut débit (ou sont en train d'étendre leur réseau d'infrastructure) et fournissent déjà des services compétitifs d'accès au haut débit avec une couverture appropriée, la mise en place d'une infrastructure à haut débit parallèle, compétitive et financée par des fonds publics ne devrait pas être qualifiée de SIEG au sens de l'article 86 du traité Toutefois, dès lors qu'il peut être démontré que des investisseurs privés pourraient ne pas être en mesure d'assurer, dans un avenir proche , une couverture adéquate pour l'ensemble des citoyens ou des utilisateurs et qu'ils risqueraient ainsi de priver de connexion une partie importante de la population, une compensation de service public peut être accordée à une entreprise chargée d'un SIEG pour autant que les conditions énoncées aux points (25) à (29) soient réunies.
