Following the adoption of Regulation (EC) No 298/2009 a team of European experts carried out a visit in Ukraine from 25 to 29 May 2009 to verify the status of implementation of the action plan submitted by the competent authorities of Ukraine to enhance oversight as well as the safety situation of the two carriers whose operations are subject to an operating ban in the Community — Ukraine Cargo Airways and Ukrainian Mediterranean Airlines.
À la suite de l’adoption du règlement (CE) no 298/2009, une équipe d’experts européens a effectué une visite en Ukraine du 25 au 29 mai 2009 pour savoir où en était la mise en œuvre du plan d’action présenté par les autorités compétentes de ce pays en vue de renforcer la surveillance et la sécurité des deux transporteurs qui font l’objet d’une interdiction d’exploitation dans la Communauté, à savoir Ukraine Cargo Airways et Ukrainian Mediterranean Airlines.

Austria communicated to the Commission that it adopted an immediate operating ban on the aircraft of type AN-12 of Ukraine Cargo Airways operating hitherto to Austria taking into account the common criteria, in the framework of Article 6(1) of Regulation (EC) No 2111/2005 and submitted to the Commission a request to update the Community list in accordance with Article 4(2) of Regulation (EC) No 2111/2005 and Article 6 of Regulation (EC) No 473/2006.
L’Autriche a indiqué à la Commission qu’elle avait prononcé une interdiction d’exploitation immédiate applicable à l’appareil de type AN-12 d’Ukraine Cargo Airways opérant jusqu’à présent en Autriche, en tenant compte des critères communs, dans le cadre de l'article 6, paragraphe 1, du règlement (CE) no 2111/2005, et a soumis à la Commission une demande d'actualisation de la liste communautaire conformément à l’article 4, paragraphe 2, du règlement (CE) no 2111/2005 et à l’article 6 du règlement (CE) no 473/2006.

During consultations with the Commission and some Member States, Ukraine Cargo Airways submitted a plan of corrective actions which according to the carrier addresses all safety deficiencies in the area of maintenance, engineering and operations identified on all three types of aircraft with which the carrier has been operating into the Community.
Dans le cadre de ses consultations avec la Commission et certains États membres, Ukraine Cargo Airways a présenté un plan de mesures correctrices qui, de l’avis du transporteur, remédie à tous les manquements en matière de sécurité décelés dans le domaine de la maintenance, de l'ingénierie et des opérations sur les trois types d’appareils avec lesquels le transporteur opère dans la Communauté.

Also, these authorities confirmed that they had endorsed the corrective action plan of the carrier and committed to verify the implementation of the corrective actions by Ukraine Cargo Airways before authorising the carrier to resume operations with its AN-12 aircraft into the Community.
De surcroît, les autorités ukrainiennes ont confirmé avoir approuvé le plan de mesures correctrices du transporteur et se sont engagées à contrôler la mise en œuvre de ces mesures par Ukraine Cargo Airways avant d'autoriser le transporteur à reprendre ses opérations dans la Communauté avec ses appareils de type AN-12.

Pending the completion of such examination, and in the absence of any corrective actions able to redress the recurrence of systemic safety deficiencies without delay, the Commission considers that the carrier should not be allowed to operate into the Community until it has been verified that adequate measures have been put in place to ensure compliance with the relevant safety standards of the operation of any aircraft used by Ukraine Cargo Airways.
Dans l’attente des résultats de cet examen et en l’absence de toute mesure correctrice capable de remédier sans délai au caractère récurrent et systémique des manquements en matière de sécurité, la Commission considère que le transporteur ne peut être autorisé à opérer dans la Communauté tant qu'il n'aura pas été vérifié que des mesures appropriées ont été mises en place pour garantir le respect des normes de sécurité applicables à l’exploitation de tous les appareils utilisés par Ukraine Cargo Airways.

Today, the Community list has four carriers whose operations are fully banned in the European Union: Ariana Afghan Airlines from Afghanistan, Blue Wing Airlines from Surinam, Siem reap Airways International from Cambodia and Silverback Cargo Freighters from Rwanda.
