7. Is firmly convinced that there is no doubt that the atrocities perpetrated by ISIS/Daesh fall within the legal definition of genocide provided in Articles 2 and 3 of the Convention on the Prevention and Punishment of Genocide and Article 6 of the Rome Statute of the International Criminal Court; stresses that genocide amounts to any act committed with the intent to destroy, in whole or in part, a national, ethnic, racial or religious group; underlines that the destruction of only part of a group on the basis of their nationality, ethnic group or religion also amounts to genocide; further emphasises that according to those legal provisions acts of genocide do not necessarily need to cause the death of member of a group, as causing serious bodily or mental harm including inflicting trauma, torture, rape, sexual violence and mutilation, as well as the transfer of children, are also to be considered acts of genocide when committed as part of a policy to destroy a group’s existence; finally underlines that mere conspiracy, direct and public incitement, attempts to commit genocide and complicity with genocide are also tantamount to the crime of genocide even before mass murders have begun;

Expresses its view that the persecution, atrocities and international crimes amount to war crimes and crimes against humanity; stresses that the so-called ‘ISIS/Daesh’ is committing genocide against Christians and Yazidis, and other religious and ethnic minorities, who do not agree with the so-called ‘ISIS/Daesh’ interpretation of Islam, and that this therefore entails action under the 1948 United Nations Convention on the Prevention and Punishment of the Crime of Genocide; underlines the fact that those who intentionally, for ethnic or religious reasons, conspire in, plan, incite, commit or attempt to commit, are complicit in or support atrocities should be brought to justice and prosecuted for violations of international law, notably war crimes, crimes against humanity and genocide;

Anybody who kills a single human being commits a crime, but those who commit genocide represent an international and political challenge.
Quiconque tue un être humain commet un crime, mais ceux qui se rendent coupables de génocide constituent un véritable défi international et politique.

In order to increase the effectiveness of the investigation and prosecution by law enforcement authorities of persons who have committed genocide, crimes against humanity and war crimes, the Council adopted Decision 2002/494/JHA on setting up a network of contact points on genocide and Decision 2003/335/JHA on the investigation and prosecution of serious international crimes.
Afin de permettre aux autorités chargées de faire respecter la loi d’accroître l’efficacité des enquêtes et des poursuites pénales se rapportant aux personnes coupables de génocide, de crimes contre l’humanité et de crimes de guerre, le Conseil a adopté la décision 2002/494/JAI portant création d’un réseau européen de points de contact en ce qui concerne les personnes responsables de génocide et la décision 2003/335/JAI concernant les enquêtes et les poursuites pénales relatives aux crimes internationaux graves.

The aim of this Decision is to increase cooperation between national units in order to maximise the ability of law enforcement authorities in different Member States to cooperate effectively in the field of investigation and prosecution of persons who have committed or participated in the commission of genocide, crimes against humanity or war crimes as defined in Articles 6, 7 and 8 of the Rome Statute of the International Criminal Court of 17 July 1998.
La présente décision a pour objectif de renforcer la coopération entre les unités nationales de manière à améliorer le plus possible l'aptitude des services répressifs des différents États membres à coopérer de manière efficace en ce qui concerne les enquêtes et les poursuites dirigées contre les personnes qui ont commis des génocides, des crimes contre l'humanité ou des crimes de guerre, tels que les définissent les articles 6, 7 et 8 du statut de la Cour pénale internationale adopté à Rome le 17 juillet 1998, ou qui ont participé à la commission de tels actes.

(7) The competent authorities of the Member States are to ensure that, where they receive information that a person who has applied for a residence permit is suspected of having committed or participated in the commission of genocide, crimes against humanity or war crimes, the relevant acts may be investigated, and, where justified, prosecuted in accordance with national law.

The network meets twice a year at meetings convened by the Presidency of the Council of the EU to coordinate on-going efforts to investigate and prosecute persons suspected of having committed or participated in genocide, crimes against humanity and war crimes.
Ce réseau réunit ses membres deux fois par an lors de réunions convoquées par la présidence du Conseil de l’UE afin de coordonner le travail en cours sur les enquêtes et poursuites de personnes suspectées d’avoir commis ou participé à un génocide, à des crimes contre l’humanité ou des crimes de guerre.
