There has been criticism of our supreme court but I suggested at the time of the adoption of the charter of rights and freedoms in 1982 that it would effect fundamental changes in our constitutional system and it logically should be accompanied by a reform, a recasting of the supreme court and the judicial role. Not having had this advice followed, I have sympathy for judges who are under attack.

– to fully restore the prerogatives of the Constitutional Court as the supreme body of constitutional protection, and thus the primacy of the Fundamental Law, by removing from its text the limitations on the Constitutional Court’s power to review the constitutionality of any changes to the Fundamental Law, as well as the abolition of two decades of constitutional case law; to restore the right of the Constitutional Court to review all legislation without exception, with a view to counterbalancing parliamentary and executive actions and ensuring full judicial review; such a judicial and constitutional review may be exerted in different ways in different Member States, depending on the specificities of each national constitutional history, but once established, a Constitutional Court – like the Hungarian one, which after the fall of the communist regime has rapidly built a reputation among Supreme Courts in Europe – should not be subject to measures aimed at reducing its competences and thus undermining the rule of law;

Notes the progress in reform of the judiciary, as demonstrated by the adoption of major amendments to criminal procedures and other substantive legislation, increasing the human resources available and reducing the backlog of cases in the courts; stresses, however, the need for ensuring accountability and efficiency of the judiciary and prosecutors as well as their independence from political interference; stresses the need to ensure full implementation of the Code of Ethics; calls urgently for changes in the system for the appointment of judges and prosecutors, and an end to the practice of nomination of prosecutors and the members of the Judicial and Prosecutorial Councils solely by parliament by simple majority and by the government; is concerned, moreover, by the potential for an excessive accumulation of power in the persons of the President of the Supreme Court and of the Supreme Public Prosecutor; calls for the adoption of the law on regulating access to free legal aid; calls for the unification of jurisprudence in order to ensure a predictable judicial system and public trust; emphasises the importance of enhancing international cooperation, especially with neighbouring countries;
