1. In the event of a serious infringement of Community road transport legislation committed or ascertained in any Member State, in particular with regard to the rules applicable to vehicles, driving and rest periods for drivers and the provision without authorisation of parallel or temporary services, as referred to in the fifth subparagraph of Article 5(1), the competent authorities of the Member State of establishment of the carrier who committed the infringement shall take appropriate action, which may include a warning if provided for by national law, to pursue the matter.

En cas d’infraction grave à la législation communautaire dans le domaine des transports par route commise ou constatée dans tout État membre, notamment en ce qui concerne les règles applicables aux véhicules, aux temps de conduite et de repos des conducteurs et à l’exécution sans autorisation des services parallèles ou temporaires visés à l’article 5, paragraphe 1, cinquième alinéa, les autorités compétentes de l’État membre d’établissement du transporteur qui a commis l’infraction prennent des mesures appropriées pouvant comporter un avertissement si le droit national le prévoit, pour y donner suite.

The competent authorities of the Member State of establishment of the carrier who committed the infringement may, inter alia, withdraw the Community licence or make temporary or permanent withdrawals of some or all of the certified true copies of the Community licence.

Also, these authorities confirmed that they had endorsed the corrective action plan of the carrier and committed to verify the implementation of the corrective actions by Ukraine Cargo Airways before authorising the carrier to resume operations with its AN-12 aircraft into the Community.

2. So far as concerns articles stowed on the outside of the vehicle, including the boxes referred to in paragraph 1, the carrier shall be liable in respect of articles placed on the outside of the vehicle only if it is proved that the loss or damage results from an act or omission, which the carrier has committed either with intent to cause such a loss or damage or recklessly and with knowledge that such loss or damage would probably result.
