2a. A competent authority of a Member State may deem a benchmark administered within its jurisdiction to be critical where it has an average notional value totalling less than the amount set in point (a) of the first subparagraph of paragraph 1 if it considers that the cessation of that benchmark would have a significant adverse impact on the integrity of markets, financial stability, consumers, the real economy, or the financing of households and corporations within its jurisdiction.
2 bis. Where a competent authority of a Member State or ESMA considers that a benchmark administered in another Member State with an average notional value totalling less than the amount set in point (a) of the first subparagraph of paragraph 1 should nevertheless be deemed to be critical, as the cessation of that benchmark would have a significant adverse impact on the integrity of markets, financial stability, consumers, the real economy, or the financing of households and corporations within its jurisdiction, it shall issue a request to the national competent authority of the relevant benchmark administrator to categorise the benchmark as critical.
Lorsqu'une autorité compétente d'un État membre ou l'AEMF estime qu'un indice de référence administré dans un autre État membre dont la valeur notionnelle moyenne est inférieure au montant fixé au paragraphe 1, premier alinéa, point a), devrait néanmoins être jugé d'importance critique, car la cessation de cet indice aurait des incidences négatives notables sur l'intégrité des marchés, la stabilité financière, les consommateurs, l'économie réelle ou le financement des ménages et des sociétés au sein de sa juridiction, elle demande à l'autorité compétente nationale de l'administrateur de l'indice de référence en question de classer l'indice de référence parmi les indices d'importance critique.
