With regard to what is known as the substitution approach, set out in Amendment No 23, I do not believe it is applicable in this context, for the companies and the industrial system we are addressing need facts and certainties – which we are providing in this directive – precisely in order to be able to invest in research and develop the formulas necessary to achieve the objectives.

(5) Taking into account the fact that the list of persons, entities and bodies whose funds should be frozen has been determined under the sole responsibility of the relevant UN Sanctions Committee , in order to create maximum legal certainty within the Community, the names and other relevant data with regard to persons, entities and bodies whose funds should be frozen further to a designation by the UN authorities, should be made publicly known and a procedure should be established within the Community to amend these lists and to request the proper procedure for the revision of the lists by the Sanctions Committee, in particular since the list in Annex I of the Regulation includes European Union citizens whose assets have been frozen, despite the fact that no judicial proceedings have taken place and no evidence has been provided .

In order to fully understand what I am going to say with regard to the Commission’s reaction to the various amendments, it should be made clear that the proposal, in our view, aims to authorise a maximum length of 15 metres throughout the European Union, provided that two requirements are complied with: firstly, that buses of between 12 and 15 metres have three axles – an important issue which I will discuss later and which has led to some debate – and, secondly, that buses are manoeuvrable, that is to say, that their manoeuvrability is in accordance with Community legislation.
