6. The President, the Vice-President and all Assistant Vice-Presidents of the Agency shall have in Canada the privileges and immunities set forth in Article V of the Convention to the extent that these are set forth in the Agreement, as applicable to senior officials of the Agency and, without restricting any other privileges or immunities accorded under this section, the President and Vice-President of the Agency shall be accorded in respect of themselves, their spouses and minor children the privileges and immunities, exemptions and facilities accorded to diplomatic envoys in accordance with international law.

On Clause 2, Brian Pallister moved, That Bill C-35, in Clause 2, be amended by adding after line 20 on page 1 the following: " 2 (1) Paragraph 4(1)(a) of the Act is replaced by the following: (a) subject to subsection (1.1), extend any of the privileges and immunities accorded thereto under section 3, other than duty and tax relief privileges; (2) Section 4 of the Act is amended by adding the following after subsection (1): (1.1) The Minister of Foreign Affairs shall not extend immunity from criminal jurisdiction to any person whom the Vienna Convention on Diplomatic Relations does not identify as enjoying immunity from criminal jurisdiction unless Her Majesty in right of Canada has entered into an agreement that obliges the Minister to extend such immunity to that person" .

Reminds states who have ratified the Rome Statute that signing an agreement providing immunity from ICC prosecution with a state that has not signed the Rome Statute is not in the spirit of the Statute; calls on the United States, in particular, to ratify this Statute and to refrain from negotiating a special status for its military personnel, who would be granted a kind of 'international immunity'; calls on EU institutions and Member States to actively support states which are suffering pressure and financial sanctions because of their refusal to sign such agreements;

Welcomes the fact that all Member States have now ratified the Statute of the United Nations International Criminal Court and that this Statute entered into force on 1 July 2002, but calls on the governments and parliaments of the Member States to refrain from concluding any (bilateral) agreement that undermines the effective implementation of the Statute of the International Criminal Court, in particular agreements on immunity enabling certain citizens to evade prosecution by the International Criminal Court;
