If legal entities established in Switzerland are not eligible for funding in calls for proposals or invitations to submit proposals or contests under Programmes covered by this Agreement financed from the 2015 budget of those Programmes, on the basis of Article 10(1)(a) of Regulation (EU) No 1290/2013, for calculation of Switzerland's financial contribution issued in accordance with Annex II to this Agreement for the year 2015, the budget of the relevant programme shall be diminished by the budget of those calls, invitations to submit proposals or contests.

Welcomes the growing interest shown by a number of WTO countries in the ACTA, believes that efforts should be made to include emerging economies such as China, India, Brazil as well as regional trade blocs such as Mercosur, CARICOM and ASEAN, in order for them to take part in the negotiations of the agreement, inviting them from now to commit themselves to guarantee IPRs' respect in their territories;

Validity of the invitation to tender: This invitation to tender shall be valid only to the extent that no EEA carrier (EEA carrier means a Community air carrier or an air carrier with a valid operating license granted by an EFTA State, party to the EEA Agreement, in accordance with the Act referred to in point 66b in Annex XIII of the EEA Agreement (Council Regulation (EEC) No 2407/92 on licensing of air carriers)) informs the Ministry of Communications, 4 weeks or more before the intended entry of force of the contract, that it will commence scheduled flights according to the public service obligations on any of the air routes without requiring any financial support or market protection.

Validité de l'appel d'offres: Le présent appel d'offres n'est valable que pour autant qu'aucun transporteur de l'EEE (par transporteur de l'EEE, on entend un transporteur aérien de la Communauté titulaire d'une licence d'exploitation valable délivrée par un pays de l'AELE partie à l'accord EEE, conformément à l'acte visé au point 66b de l'annexe XIII de l'accord EEE [règlement (CEE) no 2407/92 du Conseil concernant les licences des transporteurs aériens]) n'informe le Ministère des communications, quatre semaines au moins avant l'entrée en vigueur du contrat, de son intention de commencer à exploiter des vols réguliers, conformément aux obligations de service public imposées aux liaisons aériennes, sans demander ni soutien financier ni protection du marché.

INVITES the Commission to present a proposal for guiding principles for the management of Mutual Recognition Agreements covering the preparation, negotiation and implementation phases and to draw up a draft model agreement as a basis for negotiations and conclusions of future such Agreements, taking into account the experience gained from already concluded agreements.
