3. The provisions of this Directive concerning comparative advertising shall not oblige Member States which, in compliance with the provisions of the Treaty, maintain or introduce advertising bans regarding certain goods or services, whether imposed directly or by a body or organisation responsible, under the law of the Member States, for regulating the exercise of a commercial, industrial, craft or professional activity, to permit comparative advertising regarding those goods or services.
3. The first concerns the prohibition on advertising in the press, with regard to which the general statement deriving from the decisions of the Court of Justice on the advertising of tobacco products to the effect that a ban on advertising can be contemplated, in principle, on the basis of Article 95, should probably be understood according to the very narrow Court interpretation of the Community’s competences in the area of the internal market and not as a kind of carte blanche for the issue of a general ban on the advertising of tobacco products in the press. This is as the current legislation stands.
La première concerne l'interdiction de la publicité par voie de presse : l'affirmation générale qui découle des décisions de la Cour de justice concernant la publicité des produits en faveur du tabac et selon laquelle une interdiction de la publicité est envisageable, en principe, sur la base de l'article 95, doit probablement être considérée selon l'interprétation très restrictive que la Cour donne des compétences de la Communauté en matière de marché intérieur, et non comme une sorte de carte blanche pour la promulgation d'une interdiction générale de la publicité en faveur des produits du tabac par voie de presse : telle est la législation en vigueur.
