1. In determining whether to impose a financial penalty and in determining the appropriate financial penalty, the Commission shall be guided by the principles of effectiveness, proportionality and dissuasiveness.
1. Lorsqu’elle décide s'il convient ou non d'infliger une sanction financière et qu’elle détermine la sanction financière appropriée, la Commission est guidée par les principes d’effectivité, de proportionnalité et de dissuasion.

16. In order to, where necessary, reinforce the deterrent effect of the exclusion and/or financial penalty, the Commission shall, subject to a decision of the contracting authority, publish on its internet site the following information related to the exclusionand, where applicable, the financial penalty in the cases referred to in points (c), (d), (e) and (f) of paragraph 1 of this Article:
16. (6) To guarantee a sufficient degree of road safety and to ensure that the financial penalties applicable are proportionate, the Commission should hold discussions with the Member States on the introduction of harmonised fixed financial penalties for road traffic infringements and should also encourage the exchange of best practices between Member States.
(6) Afin de garantir un niveau suffisant de sécurité routière et de faire en sorte que les sanctions pécuniaires applicables soient proportionnées, la Commission devrait débattre avec les États membres de l'introduction de sanctions pécuniaires fixes harmonisées pour les infractions routières et devrait également encourager l'échange des bonnes pratiques entre les États membres.

( 4) Decisions requiring financial penalties to be paid have to be taken in accordance with the European Convention for the Protection of Human Rights and Fundamental Freedoms of 4 November 1950, and the Charter of Fundamental Rights of the European Union, signed and proclaimed by the European Parliament, the Council and the Commission on 7 December 2000 .
