26 (1) When a person is convicted of an offence for acquiring, having in their possession, selling, offering for sale, storing, using, making, manufacturing, transporting, importing, exporting or delivering any explosive or restricted component, the court or judge, in addition to any other penalty that may be imposed, shall, in the case of an illicitly manufactured or illicitly trafficked explosive or an explosive that is not an authorized explosive, and may, in the case of an authorized explosive or a restricted component, declare that the explosive or restricted component by means of which or in relation to which the offence was committed be forfeited to the Crown.

5. Where a court has, pursuant to subsection 16(1) of the Act, directed that a device or a component of a device be forfeited to Her Majesty, and where no application under section 75 of the Fisheries Act has been made or a declaration as provided in subsection 75(4) of that Act is not included in the final order made pursuant to that section, the device or component shall be disposed of as the Minister directs.

Where any component, unit or other element of the Canadian Forces is serving in the same place or in company with any part of an armed force of any country to which Part VI of the Act has been declared to be applicable, the component, unit or other element shall be deemed to be serving together with that part of the armed forces of that country.

Recalls its repeated invitations to the Commission to present a proposal for the introduction of mandatory national management declarations (NMDs) issued and signed at ministerial level, made public and duly audited by an independent auditor so far as such declarations are a necessary and indispensable first step to improve the efficiency of national systems and to enhance national accountability for the use of Union money; reiterates that for Member States with federal systems or substantial decentralisation such NMDs could take the form, in whole or in part, of a collation of regional declarations, provided that each component declaration has been audited and signed by an elected political office-holder; insists that the Commission will present such a proposal by September 2011 irrespective of the fact that some Member States might not yet agree with such an initiative;

Except where Member States consider that the transfer of sub-systems or components is sensitive, Member States shall refrain from imposing any export limitations for such sub-systems or components if the recipient provides a declaration of use by which it declares that the sub-systems or components subject to that transfer licence are integrated into its own products and therefore cannot be at a later stage transferred or exported as such.

Member States shall not prohibit, restrict or impede the placing on the market and/or putting into service of components referred to in Annex II and bearing the CE marking referred to in Annex IV which indicates their conformity with the relevant essential requirements where these components are accompanied by a written declaration of conformity as provided for in Annex XV and are intended to be incorporated into recreational craft, in accordance with the declaration, referred to in Annex IIIb, of the manufacturer, his authorised representative established in the Community or, in the case of imports from a third country, of any person who places those components on the Community market.

' Motion No. 166 That Bill C-68 be amended by adding after line 33, on page 65, the following new Clause: ``129.4 (1) The Governor in Council may, by order, declare for any purpose referred to in subsection (2) any period as an amnesty period with respect to any weapon, prohibited device, prohibited ammunition, explosive substance or component or part designed exclusively for use in the manufacture of or assembly into an automatic firearm (2) An order made under subsection (1) may declare an amnesty period for the purpose of (a) permitting any person in possession of any thing to which the order relates to do anything provided in the order, including, without restricting the generality of the foregoing, delivering the thing to a peace officer, a firearms officer or a chief firearms officer, registering it, destroying it or otherwise disposing of it; or (b) permitting alterations to be made to any prohibited firearm, prohibited weapon, prohibited device or prohibited ammunition to which the order relates so that it no longer qualifies as a prohibited firearm, a prohibited weapon, a prohibited device or prohibited ammunition, as the case may be (3) No person who, during an amnesty period declared by an order made under subsection (1) and for a purpose described in the order, does anything provided for in the order, is, by reason only of the fact that the person did that thing, guilty of an offence under this Part (4) Any proceedings taken under this Part against any person for anything done by the person in reliance of this section are a nullity'.
