As regards the applicant’s first argument, the Tribunal notes that it is clear, from a simple comparison between the list of the functions to be performed by the temporary agent in grade AD 5 who was to be recruited, as given in the vacancy notice, and the list of functions in the job description for the post occupied by the applicant when he was a seconded national expert, that that argument has no basis in fact.
En ce qui concerne le premier argument du requérant, le Tribunal constate qu’il résulte d’une simple comparaison entre l’énumération des fonctions qui devaient être exercées par l’agent temporaire de grade AD 5 qui serait recruté, telle qu’elle ressort de l’avis de vacance, et celle figurant dans la fiche correspondant au poste occupé par le requérant lorsqu’il était expert national détaché que cet argument manque en fait.

As regards the applicant’s second argument, which is based on the job descriptions of the other two members of his team, both of whom are officials, one in grade AD 12 and the other in grade AD 13, it should be noted that the duties which appear in those descriptions do match the list of functions for the seconded national expert post which the applicant previously occupied, but they differ considerably from those listed in the vacancy notice.
Pour ce qui est du deuxième argument du requérant, qui s’appuie sur les fiches de poste de deux autres membres de son équipe, tous deux fonctionnaires, classés l’un au grade AD 12 et l’autre au grade AD 13, il convient de relever que les tâches qui y figurent coïncident bien avec l’énumération des fonctions du poste d’expert national détaché que le requérant avait occupé, mais diffèrent considérablement de celles énumérées dans l’avis de vacance.

It should be added that the applicant’s argument that the functions of an administrator in grade AD 5, as listed in Annex I, Section A, to the Staff Regulations, correspond inter alia to those of a junior lawyer, a junior economist or a junior scientist, and that this does not match the responsibilities that he undertakes on his own, without acting in a junior capacity in relation to another official or staff member, clearly fails to take into account the job description appearing in the vacancy notice, which gives as one of the main duties that of ‘[p]reparing briefings, notes and other documents . for the senior officials and [at a] political level’.
Il y a lieu d’ajouter que l’argument du requérant selon lequel les fonctions d’un administrateur classé au grade AD 5, telles que reprises à l’annexe I, point A, du statut, correspondent notamment à celles de juriste adjoint, économiste adjoint, scientifique adjoint, ce qui s’accorderait mal avec les responsabilités qu’il assume tout seul, sans être l’adjoint d’un autre fonctionnaire ou agent, ne tient manifestement pas compte de la description des fonctions figurant dans l’avis de vacance, lequel indique, comme une des tâches principales, celle de « [p]réparer des briefings, des notes et d’autres documents [.] à l’intention des fonctionnaires d’encadrement ou du niveau politique ».

In addition to the arguments on the obligation for the GOC to provide full replies (see recitals (34) - (35) above), the Commission notes that at least one of the lower tax rates listed under this section benefited one of the cooperating exporters (see recitals (231) and following above).
