« 1. Each Party shall adopt such legislative measures as may be necessary to establish the following conduct as criminal offences under its domestic law, when committed intentionally and without right : distributing or otherwise making available, through a computer system to the public, material which denies, grossly minimises, approves or justifies acts constituting genocide or crimes against humanity, as defined by international law and recognised as such by final and binding decisions of the International Military Tribunal, established by the London Agreement of 8 August 1945, or of any other international court established by relevant international instruments and whose jurisdiction is recognised by that Party.

L'article 6, 1º, du Protocole additionnel à la Convention sur la cybercriminalité invite les Parties à adopter les mesures législatives qui se révèlent nécessaires pour ériger en infractions pénales, dans leur droit interne, lorsqu'ils sont commis intentionnellement et sans droit, les comportements suivants: la diffusion ou les autres formes de mise à disposition du public, par le biais d'un système informatique, de matériel qui nie, minimise de manière grossière, approuve ou justifie des actes constitutifs de génocide ou de crime contre l'humanité, tels que définis par le droit international et reconnus comme tels par une décision finale et définitive du Tribunal militaire international, établi par l'Accord de Londres du 8 août 1945, ou par tout autre tribunal international établi par des instruments internationaux pertinents et dont la juridiction a été reconnue par cette Partie.

17. Calls on OSCE participating States to ensure that the production, distribution, dissemination, importation, exportation, offering, selling or possessing of child pornography, or any attempt to commit any of these acts, or any complicity or participation in any of these acts, are fully covered under national criminal or penal law, whether such offences are committed domestically or transnationally or on an individual or organized basis, and are punishable by appropriate penalties that take into account their grave nature;
17. Invite les États participants de l'OSCE à veiller à ce que la production, la distribution, la diffusion, l'importation, l'exportation, l'offre, la vente ou la détention de matériels pornographiques mettant en scène des enfants ou toute tentative de commettre l'un quelconque de ces actes, de complicité dans ces actes ou de participation à ces actes soient pleinement couverts par leur droit pénal national, que ces infractions soient commises au plan interne ou transnational, par un individu ou de façon organisée, et à ce qu'ils soient passibles de peines appropriées tenant compte de leur gravité;

« When deciding on the range of offences to be covered as predicate offences under each of the categories listed above, each country may decide, in accordance with its domestic law, how it will define those offences and the nature of any particular elements of those offences that make them serious offences (5) ».
