In het advies dat zij heeft uitgebracht over het voorontwerp van wet tot hervorming van de adoptie heeft de afdeling wetgeving van de Raad van State, de « niet-definitieve aard van sommige bepalingen en leemten in het ontwerp » vaststellend, in het bijzonder opgemerkt : « [...] in de memorie van toelichting [wordt] onderstreept dat ' ... naar aanleiding van de bespreking van onderhavig wetsontwerp (zal) moeten worden onderzocht of op termijn de mogelijkheid moet worden voorzien de adoptie toe te laten door twee samenwonenden van gelijk geslacht. Dit zal uiteraard het voorwerp moeten zijn van een ruim maatschappelijk debat dat tevens in het parlementaire halfrond zijn weerklank zal vinden'. Dat is een fundamentele vraag, want het gaat om de levenswijze en de burgerlijke staat van de personen die als adoptant in aanmerking kunnen komen. De oplossing waarvoor in het ontwerp (ontworpen artikel 344-2 van het Burgerlijk Wetboek) is gekozen, namelijk adoptie alleen toestaan hetzij aan twee al dan niet gehuwde personen van een verschillend geslacht, hetzij aan vrijgezellen, is klaarblijkelijk niet definitief. De steller van het ontwerp wordt erop attent gemaakt dat enerzijds zulk een aangelegenheid niet mag worden overgelaten aan de instanties van de gemeenschappen in het kader van het onderzoek naar de geschiktheid van de kandidaat-adoptant om een kind te adopteren en dat anderzijds aan het Arbitragehof vaak prejudiciële vragen zijn gesteld in verband met adoptie, waarbij problemen inzake gelijkheid en non-discriminatie tussen de verschillende categorieën van adoptanten zijn opgeworpen » (ibid., 2000-2001, DOC 50-1366/001 en 50-1367/001, pp. 157-158).
Dans l'avis qu'elle a rendu sur l'avant-projet de loi réformant l'adoption, la section de législation du Conseil d'Etat, constatant « le caractère non définitif de certaines dispositions et lacunes du projet », avait observé en particulier : « [...] l'exposé des motifs souligne qu'il faudra examiner, '... à l'occasion de la discussion du présent projet, si, à terme, il faut prévoir de permettre à deux cohabitants du même sexe d'adopter. Cette question devra naturellement faire l'objet d'un large débat de société qui devra se répercuter dans l'hémicycle parlementaire'. Cette question est fondamentale puisqu'elle concerne le mode de vie, l'état civil des personnes qui pourront se porter candidates à une adoption. L'option retenue par le projet (article 344-2 en projet du Code civil), à savoir réserver l'adoption soit à des couples de sexe différent mariés ou non, soit à des célibataires, n'est visiblement pas définitivement arrêtée. L'attention de l'auteur du projet est attirée d'une part, sur le fait qu'une telle question ne peut être abandonnée aux autorités communautaires dans le cadre de l'examen de l'aptitude à adopter et que, d'autre part, la Cour d'arbitrage a souvent été saisie de questions préjudicielles en rapport avec l'adoption soulevant des problèmes d'égalité et de non-discrimination par rapport aux différentes catégories d'adoptants » (ibid., 2000-2001, DOC 50-1366/001 et 50-1367/001, pp. 157-158).

The Committee recommends that the State party should include in its next periodic report information on the results of putting into effect recently-adopted legislation, as mentioned above, and the obstacles encountered in so doing.
