TRADUCTIONS EN CONTEXTE

Any member state may, however, conclude an arrangement with the Council acting on behalf of the Organization whereby such member state will employ and assign to the Organization all of its nationals (except, if such member state so desires, any not ordinarily resident within its territory) who are to serve on the International Staff of the Organization and pay the salaries and emoluments of such persons from its own funds at a scale fixed by it. The salaries and emoluments so paid may be taxed by such member state but shall be exempt from taxation by any other member state.
Toutefois, un État membre pourra conclure avec le Conseil, agissant au nom de l'Organisation, des arrangements permettant audit État membre de recruter et d'affecter à l'Organisation ses propres ressortissants (exception faite, si cet État membre le désire, de tout ressortissant ne résidant pas habituellement sur son territoire), devant faire partie du personnel international de l'Organisation. Il paiera dans ce cas les salaires et émoluments desdites personnes sur ses propres fonds selon un barème déterminé par lui.

I am convinced that the adoption of this directive will simplify procedures for the admission of third-country nationals for employment purposes, will reduce administrative costs and also will make it easier to check on people admitted to the territory of a Member State and authorised to work there.
Je suis convaincue que l’adoption de cette directive simplifiera les procédures d’admission des ressortissants de pays tiers à des fins d’emploi, réduira les coûts administratifs et permettra également un contrôle plus aisé des personnes admises sur le territoire d’un État membre et autorisées à y travailler.

Deze perceptie is echter gewijzigd met de Laval-uitspraak, waarin het hof verklaart dat artikel 3(7) in de terbeschikkingstellingsrichtlijn “cannot be interpreted as allowing the host Member State to make the provision of services in its territory conditional on the observance of terms and conditions of employment which go beyond the mandatory rules for minimum protection”.
Cette conception se trouve toutefois modifiée par l'arrêt Laval, dans lequel la Cour déclare que l'article 3, paragraphe 7, de la directive sur le détachement de travailleurs "ne saurait être interprété en ce sens qu'il permet à l'État membre d'accueil de subordonner la réalisation d'une prestation de services sur son territoire à l'observation de conditions de travail et d'emploi allant au-delà des règles impératives de protection minimale".
