2.4 COSAC calls on the Council to assess the possibility of uploading on the IPEX website proposals made by Member States within the framework of the second and third pillar, especially any legislative proposal or initiative in relation to the establishment of an area of freedom, security and justice which might have a direct impact on the rights and freedoms of individuals.

The Commission's assessment was based on: the evaluation of the link between the redundancies and major structural changes in world trade patterns or the financial crisis; the unforeseen nature of the redundancies concerned; demonstration of the number of redundancies and compliance with the criteria of Article 2(a); the explanation of the unforeseen nature of those redundancies; the identification of dismissing enterprises and workers targeted for assistance, the territory concerned and its authorities and stakeholders; the impact of the redundancies as regards local, regional or national employment; the co-ordinated package of personalised services to be funded, including its compatibility with actions funded by the Structural Funds; dates on which the personalised services to affected workers were started or planned to start; procedures for consulting the social partners, management and control systems.
La Commission a fondé son appréciation sur: le lien entre les licenciements et les modifications majeures de la structure du commerce mondial ou la crise financière, le caractère imprévu des licenciements concernés, le nombre de licenciements, le respect des critères de l’article 2, point a), la justification de la nature imprévue de ces licenciements, l’identification tant des entreprises ayant procédé aux licenciements que des travailleurs devant bénéficier de l’aide, le territoire, les autorités et les acteurs concernés, les conséquences des licenciements sur l’emploi au niveau local, régional ou national, l’ensemble coordonné de services personnalisés à financer, et notamment leur compatibilité avec les mesures financées par les Fonds structurels, les dates auxquelles les services personnalisés proposés aux travailleurs touchés ont commencé ou doivent débuter, les procédures de consultation des partenaires sociaux, et les systèmes de gestion et de contrôle.

The criminalisation issue merits a debate in itself, but it is stated in Article 19 of the directive that the Commission will in some years submit a report to the European Parliament and the Council ‘assessing the impact of existing national law criminalising the users of services which are the objects of exploitation of trafficking in human beings on the prevention of trafficking in human beings, accompanied, if necessary, by adequate proposals’.
La question de la criminalisation doit être débattue séparément. L’article 19 de la directive prévoit que, dans quelques années, la Commission devra soumettre au Parlement européen et au Conseil «un rapport évaluant l’incidence sur la prévention de la traite des êtres humains des législations nationales en vigueur qui rendent punissable le fait de recourir aux services faisant l’objet de l’exploitation liée à la traite des êtres humains; ce rapport serait accompagné, le cas échéant, de propositions législatives appropriées».

De invloed van beleidsmaatregelen op mensenrechtengebied zou doeltreffender en zichtbaarder gemaakt kunnen worden aan de hand van een systematische effectbeoordeling betreffende de mensenrechten (Human Rights Impact Assessment - HRIA). Dergelijke effectbeoordelingen zouden door de Commissie en de Raad ontwikkeld en ten uitvoer gelegd moeten worden op het niveau waarop het beleid wordt uitgestippeld en zouden betrekking moeten hebben op externe bijstandsprogramma’s en -projecten.
L'efficacité et la visibilité de l'impact de la politique européenne en matière de droits de l'homme pourraient être accrues par une évaluation systématique de l'incidence sur les droits de l'homme, système élaboré et mis en œuvre par le Conseil et la Commission au niveau de la formulation politique, dans le cadre des projets et des programmes d'aide extérieure.
