Men notere dat het bureau van de Representative on Freedom of the Media begin juli 2011 een studie publiceerde, getiteld “Freedom of Expression on the Internet: Study of legal provisions and practices related to freedom of expression, the free flow of information and media pluralism on the Internet in OSCE Participating States”.
Le bureau de la représentante sur la Liberté des Médias a publié, début juillet 2011, une étude intitulée « Freedom of Expression on the Internet: Study of legal provisions and practices related to freedom of expression, the free flow of information and media pluralism on the Internet in OSCE Participating States ».

De hiërarchie van de beginselen wordt hier benadrukt; welbepaalde fundamentele rechten en vrijheden zijn van nature uit onaantastbaar : « certain rights are recognized as non derogable in any circumstances and that any measures derogating from the provisions of the Covenant must be in accordance with that article in all cases, and underling the exceptional and temporary nature of any such derogations and reaffirms that it is imperative that all states work to uphold and protect the dignity of individuals and their fundamental freedoms,a s well as democratic practices and the rule of law, while countering terrorism (...)».
Cette résolution met l'accent sur la hiérarchie des principes et précise que certains droits et libertés fondamentaux sont intangibles par nature: « Rappelle que (...) certains droits ne sont susceptibles de dérogation en aucune circonstance et que toute dérogation aux dispositions du Pacte doit être en conformité avec cet article dans tous les cas, et soulignant le caractère exceptionnel et provisoire d'une telle dérogation (...); réaffirme qu'il est indispensable que tous les États, dans la lutte antiterroriste, s'efforcent d'affirmer et de protéger la dignité des individus et leurs libertés fondamentales, ainsi que les pratiques démocratiques et la primauté du droit (...)».

Bijzonder belangrijk hierbij zijn de volgende overwegingen van de Commissie die de volgende beginselen herhaalt (nrs. 3 en 6) : « Recalls that, in accordance with article 4 of the International Covenant on Civil and Political Rights, certain rights are recognized as non derogable in any circumstances and that any measures derogating from the provisions of the Covenant must be in accordance with that article in all cases, and underlining the exceptional and temporary nature of any such derogations en Reaffirms that it is imperative that all States work to uphold and protect the dignity of individuals and their fundamental freedoms, as well as democratic practices and the rule of law, while countering terrorism (...)».
À cet égard, on relèvera tout particulièrement l'importance des considérations de la Commission qui rappelle les principes suivants (nºs 3 et 6): « Rappelle qu'en vertu de l'article 4 du Pacte international relatif aux droits civils et politiques, certains droits ne sont susceptibles de dérogation en aucune circonstance et que toute dérogation aux dispositions du Pacte doit être en conformité avec cet article dans tous les cas, et soulignant le caractère exceptionnel et provisoire d'une telle dérogation, réaffirme qu'il est indispensable que tous les États, dans la lutte antiterroriste, s'efforcent d'affirmer et de protéger la dignité des individus et leurs libertés fondamentales, ainsi que les pratiques démocratiques et la primauté du droit (...)».
