Sont notamment concernés par ce dispositif, les dispositifs dits hybrides et les mécanismes par lesquels des intérêts (versés par une société située dans un pays A membre de l'UE) sont assimilés dans le chef de la société bénéficiaire (localisée dans un pays B membre de l'UE) à des dividendes qui, en conséquence, dans ce dernier État, bénéficient de l'exonération au titre de ROT (par exemple des mécanismes tels que les Profit Participating Loan (PPL).
