In de leden 2 tot 6 van de bijlage bij de Overeenkomst wordt verwezen naar de volgende documenten : « National Security Compatibility Compliance for GPS and Galileo Signals in the 1559-1610 MHz Band, Part 1, Part 2 and Part 3 », « Reference Assumptions for GPS/Galileo Compatibility Analyses », « Models and Methodology for GPS/Galileo Radio Frequency Compatibility Analyses » en « GPS/Galileo Time Offset Preliminary Interface Definition ».
1. L'annexe de l'accord se réfère, dans ses paragraphes 2 à 6, aux documents suivants: « National Security Compatibility Compliance for GPS and GALILEO Signals in the 1559-1610 Mhz Band, Part 1, Part 2 and Part 3 », « Reference Assumption for GPS/GALILEO Compatiblity Analyses », « Models and Methodology for GPS/GALILEO Radio Frequency Compatibility Analyses », et « GPS/GALILEO Time Offset Preliminary Interface Definition ».

Daartoe worden hun respectieve satellietnavigatie- en -tijdsbepalingssignalen in overeenstemming gebracht met de criteria voor de verenigbaarheid met de nationale veiligheid, als beschreven in de documenten met de titels « National Security Compatibility Compliance for GPS and Galileo Signals in the 1559-1610 MHz Band, Part 1, Part 2 and Part 3 » (hierna « de documenten inzake criteria, aannames en methodologie » genoemd), waarnaar wordt verwezen in de bijlage, met behulp van de methodologie en de aannames die in de documenten inzake criteria, aannames en methodologie zijn opgenomen.
À cette fin, leurs signaux respectifs de navigation et de datation par satellite sont conformes aux critères de compatibilité avec la sécurité nationale prévus dans les documents intitulés « National Security Compatibility Compliance for GPS and GALILEO Signals in the 1559-1610 MHz Band, Part 1, Part 2 and Part 3 » (ci-après dénommés Criteria, Assumption and methodology Documents), référencés dans l'annexe jointe, en utilisant la méthodologie et les hypothèses contenues dans les Criteria, Assumption and Methodology Documents.

(2) De geclassificeerde aannames en methodologie op basis waarvan de criteria voor de verenigbaarheid met de nationale veiligheid worden vastgesteld, alsmede deze criteria zelf zijn opgenomen in de documenten « National Security Compatibility Compliance for GPS and Galileo Signals in the 1559-1610 MHz Band, Part 1, Part 2 and Part 3 » (hierna respectievelijk « deel 1 », « deel 2 » en « deel 3 » genoemd), van 9 juni 2004, met inbegrip van eventuele toekomstige amendementen, wijzigingen, of aanpassingen daarop die wederzijds door de partijen worden overeengekomen overeenkomstig punt 6, onder a) van deze bijlage.
(2) Les hypothèses et la méthodologie classifiées retenues pour déterminer les critères de compatibilité de sécurité nationale, ainsi que les critères eux-mêmes, figurent dans les documents intitulés: « National Security Compatibility Compliance for GPS and GALILEO Signals in the 1559-1610 MHz Band, Part 1, Part 2 and Part 3 » (ci-après respectivement « Partie 1 », « Partie 2 » et « Partie 3 »,), datés du 9 juin 2004, qui inclura toutes les modifications et changements ultérieurs tels qu'ils seront convenus d'un commun accord suivant les dispositions du paragraphe 6.a. de la présente annexe.

(6) a) Onverminderd artikel 20, lid 6, worden besluiten over eventuele toekomstige amendementen, wijzigingen of aanpassingen op de documenten « National Security Compatibility Compliance for GPS and Galileo Signals in the 1559-1610 MHz Band, Part 1, Part 2 and Part 3 » op basis van wederzijdse instemming genomen door een subgroep van de uit hoofde van artikel 13, lid 2, onder d), opgerichte werkgroep, bestaande uit vertegenwoordigers van de Verenigde Staten enerzijds en uit vertegenwoordigers van de Europese Commissie die namens de Europese Gemeenschap handelen en die overeenkomstig punt 2 van deze bijlage toegang hebben tot deze geclassificeerde documenten, en vertegenwoordigers van die lidstaten die overeenkomstig punt 2 van deze bijlage toegang hebben tot deze geclassificeerde documenten anderzijds.
(6) a) Nonobstant les dispositions du paragraphe 6 de l'article 20, tous les changements et modifications apportés aux documents intitulés « National Security Compatibility Compliance for GPS and GALILEO Signals in the 1559-1610 MHz Band, Part 1, Part 2 and Part 3 » seront décidés d'un commun accord par un sous-groupe du groupe de travail mis en place en application du paragraphe 2 d) de l'article 13. Ce sous-groupe sera composé d'une part de représentants des États-Unis d'Amérique, d'autre part à la fois de représentants de la Commission européenne agissant au nom de la Communauté européenne et ayant accès aux documents classifiés suivant les dispositions du paragraphe 2 de la présente annexe et de représentants de ceux des États membres qui ont accès aux documents classifiés suivant les mêmes dispositions de la présente annexe.

The Commission's assessment was based on: the evaluation of the link between the redundancies and major structural changes in world trade patterns or the financial crisis; the unforeseen nature of the redundancies concerned; demonstration of the number of redundancies and compliance with the criteria of Article 2(a); the explanation of the unforeseen nature of those redundancies; the identification of dismissing enterprises and workers targeted for assistance, the territory concerned and its authorities and stakeholders; the impact of the redundancies as regards local, regional or national employment; the co-ordinated package of personalised services to be funded, including its compatibility with actions funded by the Structural Funds; dates on which the personalised services to affected workers were started or planned to start; procedures for consulting the social partners, management and control systems.
La Commission a fondé son appréciation sur: le lien entre les licenciements et les modifications majeures de la structure du commerce mondial ou la crise financière, le caractère imprévu des licenciements concernés, le nombre de licenciements, le respect des critères de l’article 2, point a), la justification de la nature imprévue de ces licenciements, l’identification tant des entreprises ayant procédé aux licenciements que des travailleurs devant bénéficier de l’aide, le territoire, les autorités et les acteurs concernés, les conséquences des licenciements sur l’emploi au niveau local, régional ou national, l’ensemble coordonné de services personnalisés à financer, et notamment leur compatibilité avec les mesures financées par les Fonds structurels, les dates auxquelles les services personnalisés proposés aux travailleurs touchés ont commencé ou doivent débuter, les procédures de consultation des partenaires sociaux, et les systèmes de gestion et de contrôle.
