Het Arbitragehof heeft zich daarover niet uitgesproken, maar toch lijken zij strijdig met de principes van gelijkheid en non-discriminatie (zie hierover De Gavre, « Le principe d'égalité dans le droit de la filiation : limites, exceptions et contrôle », « Revue de droit de l'ULB », 1990/1, blz. 11 en volgende; zie ook G. Mahieu en D. Pire, « La filiation », Larcier, 1999, blz. 155).
Ces restrictions n'ont pas été soumises à la censure de la Cour d'arbitrage mais elles semblent néanmoins contraires au principe d'égalité et de non-discrimination (voir notamment à ce sujet : De Gavre, « Le principe d'égalité dans le droit de la filiation : limites, exceptions et contrôle », Revue de droit de l'ULB, 1990/1, p. 11 et suivantes; voir encore : G. Mahieu et D. Pire, La filiation, Larcier, 1999, p. 155).

Deze afbakening van de horizontale beperking openbare diensten ligt ook in de lijn van de schriftelijke verklaring die de Europese Commissie aan België richtte : « The exclusion of telecommunications and computer and related services from the scope of the public utilities limitation will in itself neither affect the current EC and national regulatory regimes, including as regards the modalities for financing public service obligations such as universal service, nor the future evolution of this regime as regards the scope of universal/public service obligations and non-discriminatory regulatory obligations in the public interest.

Ook België bij monde van haar vertegenwoordiger tijdens de algemene bespreking van deze nieuwe conventie, verzekerde dat ons land zich zal blijven inspannen « to ensure that the age-limit be set at 18 years, both for participation in hostilities and for recruitment into armed forces or non-governmental armed groups ».
La Belgique, elle aussi, a assuré par la bouche de son représentant, au cours de la discussion générale de cette nouvelle convention, que notre pays continuera à oeuvrer en faveur de la fixation de la limite d'âge à dix-huit ans, pour ce qui est tant de la participation aux hostilités que du recrutement dans les forces armées ou les groupes armés non gouvernementaux.

Onlangs werd bevestigd dat British Nuclear Fuels Limited vervalste gegevens verstrekt heeft over de export van nucleaire bijproducten naar Japan. In mijn eerdere vraag H-0504/99 had ik al de aandacht gevestigd op berichten over onregelmatigheden bij de controles op kernbrandstoffen die voor export bestemd zijn. De Commissie antwoordde daarop dat zij, zodra de resultaten van het onderzoek beschikbaar zouden zijn, een besluit zou nemen over de vraag of deze kwestie onder haar bevoegdheden valt. Kan de Commissie nu mededelen wat haar standpunt is ten aanzien van haar bevoegdheid en zal zij er bij de Britse regering op aandringen om in de toekomst vergunningen aan British Nuclear Fuels Limited voor de productie van Mox-kernbrandstof te weigeren?
Compte tenu de la récente confirmation de la falsification de données par British Nuclear Fuels Limited concernant des sous-produits nucléaires exportés au Japon et en référence à ma question antérieure H-0504/99 , dans laquelle j'ai attiré l'attention sur des allégations d'irrégularités portant sur le contrôle du combustible nucléaire destiné à l'exportation, et à la réponse de la Commission, selon laquelle elle statuerait sur sa compétence en la matière une fois les résultats de l'enquête disponibles, la Commission pourrait-elle à présent se prononcer sur la question des compétences et inviter instamment le gouvernement britannique à refuser d'accorder à l'avenir des licences à British Nuclear Fuels Limited pour la fabrication de combustible MOX ?
