Op 4 november 2002 presenteerde een groep van deskundigen op hoog niveau op het gebied van het vennootschapsrecht, die door Commissaris Bolkestein in september 2001 was opgericht onder voorzitterschap van Jaap Winter, haar eindverslag met de titel "A modern regulatory framework for company law in Europe".

Dit is een tautologie die wellicht enigszins lachwekkend zou zijn als zij geen deel uitmaakte van een wettekst waarmee onze grondrechten worden geschonden. Het is dan ook betreurenswaardig dat het voorstel van het Comité I niet werd gevolgd (L. Nous sommes ici face à une tautologie qui, si elle n'apparaissait pas dans un texte légal prévoyant une série d'entraves à l'exercice de nos libertés individuelles, prêterait à sourire .Il semble dès lors particulièrement regrettable que la proposition du Comité R visant à préciser les compagnies ou les recherches poursuivies n'ait pas été suivie (L. De Commissie heeft bovendien gebruik gemaakt van de verslagen van het Europees Netwerk van onafhankelijke deskundigen op het gebied van non-discriminatie, en met name van hun overzicht "Developing Anti-Discrimination Law in Europe"[15] en van de studie "Tackling Multiple Discrimination: practices, policies and laws"[16].
La Commission a en outre utilisé les rapports du Réseau européen des experts indépendants en matière de non-discrimination, notamment le document sur «Le développement de la législation contre les discriminations en Europe»[15], ainsi qu’une étude intitulée «Lutte contre la discrimination multiple: pratiques, politiques et lois»[16].
