Die kritiek komt ook uit de rechterlijke macht. De afgelopen maanden spraken zowel de European Association of Judges in hun Statement on the proposal from the European Commission on a new investment court system van 9 november 2015 als de Deutscher Richterbund in hun Opinion on the establishment of an investment tribunal in TTIP - the proposal from the European Commission on 16.09.2015 and 11.122015 No. 04/16, February 2016 (Engelse vertaling) zich erg kritisch uit tegen dit hervormde Investment Court System.
Ces derniers mois, tant l'Association européenne des Magistrats dans son Statement on the proposal from the European Commission on a new investment court system du 9 novembre 2015 que la Deutscher Richterbund dans son 'Opinion on the establishment of an investment tribunal in TTIP - the proposal from the European Commission on 16.09.2015 and 11.122015 No. 04/16, February 2016' (traduction anglaise) ont vivement critiqué ce nouveau système juridictionnel des investissements.

Er is wel een politiek akkoord over de mogelijkheid voor een uitzondering in specifieke omstandigheden: "Member States may grant exemptions from the measures imposed in paragraph 1 where travel is justified on the grounds of urgent humanitarian need, or in exceptional cases on grounds of attending intergovernmental meetings and those promoted or hosted by the European Union, where a political dialogue is conducted that directly promotes the policy objectives of restrictive measures, including democracy, human rights and the rule of law in Zimbabwe".

The Assembly shall consist of 280 members, 130 EU members (81 members of the 27 EU national parliaments, on the basis of equal representation, and 49 members of the European Parliament), 10 members from the parliaments of the European Mediterranean partner countries (2 members for each of the delegations from Albania, Bosnia and Herzegovina, Croatia, Monaco, and Montenegro), 130 members of the parliaments of the ten founding Mediterranean partners, on the basis of equal representation, and 10 members from the Mauritanian Parliament.
