Van woensdag 30 september tot en met 4 oktober vond in het hartje van Antwerpen de 15e Training Conference plaats van de European Prison Education Association (EPEA).
Du mercredi 30 septembre au 4 octobre s'est tenue la 15e « Training Conference » de l'« European Prison Education Association » (EPEA) au cœur d'Anvers.

De memorie van toelichting vermeldt : « Artikel 84 van de wet wordt aangevuld teneinde duidelijk te stellen dat geen arbeidsovereenkomst in de zin van de wet van 1978 gesloten wordt met gedetineerden die penitentiaire arbeid uitvoeren. Immers, het feit dat er in hoofde van de penitentiaire administratie een verplichting bestaat om de gedetineerden te werk te stellen gaat in tegen het principe zelf van een contractuele relatie, wat een wilsvrijheid van de contractanten impliceert. Op het operationele vlak zou de gelijkstelling met een echte arbeidsovereenkomst, met alle gevolgen die dat impliceert (administratieve werklast, bedrag van de vergoedingen,...), leiden tot de onmogelijkheid om gedetineerden te werk te stellen. Het is dan ook verkieslijk om, net zoals dit het geval is in Frankrijk, dit expliciet in de wetgeving te verankeren. Gevolg gevend aan de opmerkingen van de Raad van State wordt er op gewezen dat de regelgeving die de penitentiaire arbeid beheerst, terug te vinden is in de Basiswet zelf, in de koninklijke besluiten die voorbereid worden en in de huishoudelijke reglementen die door de minister van Justitie goedgekeurd zijn. Bij het uitwerken van deze regelgeving werd rekening gehouden met de European Prison Rules. In afwachting van het koninklijk besluit omtrent arbeidsongevallen in de gevangenissen wordt ten aanzien van gedetineerden die het slachtoffer zijn van een werkongeval toepassing gemaakt van een vergoedingssysteem dat gebaseerd is op de billijkheid, welk voorzien is in een aantal ministeriële omzendbrieven. Ten slotte is de federale regelgeving betreffende welzijn op het werk van toepassing op de penitentiaire arbeid » (Parl. St., Kamer, 2012-2013, DOC 53-2744/001, pp. 5-6).
L'exposé des motifs mentionne : « L'article 84 de la loi est complété de manière à affirmer clairement qu'aucun contrat de travail au sens de la loi de 1978 n'est conclu avec les détenus qui exécutent un travail pénitentiaire. En effet, le fait qu'il y ait une obligation dans le chef de l'administration de mettre les détenus au travail contredit l'idée même de relation contractuelle, laquelle implique une volonté libre des contractants. Sur le plan opérationnel, l'assimilation à un vrai contrat de travail, avec toutes les conséquences que cela implique (charge de travail administratif, montant des rétributions,...), aboutirait à une impossibilité de mettre encore des détenus au travail. Il est donc préférable, comme c'est le cas en France par exemple, que ce principe figure de manière explicite dans la législation. Afin de donner suite aux remarques du Conseil d'Etat, il convient de renvoyer au fait que la réglementation qui régit le travail pénitentiaire se trouve dans la loi de Principes elle-même, dans les arrêtés royaux en cours d'élaboration et dans les règlements d'ordre intérieur qui ont été approuvés par la ministre. L'élaboration de cette réglementation a pris en compte les Règles pénitentiaires européennes. Dans l'attente de l'arrêté royal relatif aux accidents du travail dans les prisons, un système d'indemnisation basé sur l'équité est d'application aux détenus victimes d'un accident du travail, ce système est décrit par une série de circulaires. Enfin, la réglementation fédérale sur le bien-être au travail est d'application au travail pénitentiaire » (Doc. parl., Chambre, 2012-2013, DOC 53-2744/001, pp. 5-6).

11. Urges all the Barcelona Process partners to develop procedures subject to parliamentary scrutiny and legal review for exchanges of intelligence at bilateral and regional level in order to heighten the effectiveness of the fight against terrorism; in this spirit, welcomes the European Parliament resolution on the alleged use of European countries by the CIA for the transportation and illegal detention of prisoners and calls on those Euro-Mediterranean partners against whom serious accusations have been made of active or passive cooperation in extraordinary renditions to open or continue their own parliamentary and/or judicial investigations and enquiries;
11. engage tous les partenaires du Processus de Barcelone à développer des procédures d'échanges d'information, soumises au contrôle parlementaire et judiciaire, au plan bilatéral et régional de manière à rendre plus efficace la lutte contre le terrorisme; approuve, dans cet esprit, la résolution du Parlement européen sur l'utilisation alléguée de pays européens par la CIA pour le transport et la détention illégale de prisonniers, et invite les pays euro-méditerranéens faisant l'objet d'allégations graves de coopération active ou passive en matière de restitutions extraordinaires à mener ou à poursuivre leurs investigations et enquêtes au niveau parlementaire et/ou judiciaire;

Deze gezamenlijke actie moet voortbouwen op de onderstaande onderzoeks- en innovatieprojecten, hun uitvoering in de klinische praktijk bevorderen en gebruikmaken van hun resultaten en uitkomsten: CEDAR („Clinical decision making and outcome in routine care for people with severe mental illness”) (34), COPING („Children of Prisoners, Interventions Mitigations to Strengthen Mental Health”) (35), ENBREC („European Network of Bipolar Research Expert Centres”), MentDis_ICF65+ („Prevalence, 1-year incidence and symptom severity of mental disorders in the elderly: Relationship to impairment, functioning (ICF) and service utilisation”) (36), REFINEMENT („Financing systems' effects on the Quality of Mental health care in Europe”), ROAMER („A Roadmap for Mental Health Research in Europe”), SEYLE („Save Young Lives in Europe: Promote health through prevention of risk-taking and self-destructive behaviours”) (37), TICD („Tailored implementation for chronic diseases”) en WE-STAY („Work Together to Stop Truancy Among Youth”).
Cette action conjointe devrait s’appuyer sur les projets de recherche et d’innovation ci-après, encourager leur prise en compte dans la pratique clinique et exploiter leurs résultats et réalisations: «Clinical decision making and outcome in routine care for people with severe mental illness» (CEDAR) (34), «Children of Prisoners, Interventions Mitigations to Strengthen Mental Health» (COPING) (35), «European Network of Bipolar Research Expert Centres» (ENBREC), «Prevalence, 1-year incidence and symptom severity of mental disorders in the elderly: Relationship to impairment, functioning (ICF) and service utilisation» (MentDis_ICF65+) (36), «Financing systems’ effects on the Quality of Mental health care in Europe» (REFINEMENT), «A Roadmap for Mental Health Research in Europe» (ROAMER), «Save Young Lives in Europe: Promote health through prevention of risk-taking and self-destructive behaviours» (SEYLE) (37), «Tailored implementation for chronic diseases» (TICD) et «Work Together to Stop Truancy Among Youth» (WE-STAY).

[20] Een breder Europees netwerk is opgezet en er is steun verleend aan de European Prison Education Association (EPEA) om de activiteiten ervan te versterken en uit te breiden.
