TRADUCTIONS EN CONTEXTE

Op 30 mei 2016 hebben de Europarlementsleden van de Commissie burgerlijke vrijheden, justitie en binnenlandse zaken ingestemd met een uitbreiding van het Europees Strafregister Informatiesysteem (European Criminal Records Information System - ECRIS), dat de EU-landen gebruiken om informatie over strafrechtelijke veroordelingen van EU-burgers uit te wisselen, tot de onderdanen van derde landen.
Les députés européens de la commission des Libertés civiles ont marqué leur accord le 30 mai 2016 pour que le système européen d'information sur les casiers judiciaires (ECRIS), que les pays de l'UE utilisent pour échanger des informations sur les condamnations pénales des citoyens de l'UE, soit étendu aux ressortissants de pays tiers.

Het systeem ECRIS (European Criminal Records Information System) wordt toegepast door België sinds juli 2012.

Op 19 januari 2016 stelde de Commissie voor de uitwisseling van strafregistergegevens over onderdanen van niet-EU-landen te intensiveren door het Europees Strafregister Informatiesysteem (European Criminal Records Information System - ECRIS) uit te breiden.
La Commission a proposé le 19 janvier 2016 de renforcer l'échange des casiers judiciaires des ressortissants des pays non membres de l'UE, en complétant le système européen d'information sur les casiers judiciaires (ECRIS).

Er werd inzonderheid beslist het project CIDaR (Criminal Information Data Referral) op poten te zetten, teneinde de uitwisseling van inlichtingen op het gebied van criminaliteit tussen onze landen te verbeteren.

21. verzoekt de lidstaten de onderlinge justitiële samenwerking middels de beschikbare EU-instrumenten, zoals het Europees Strafregisterinformatiesysteem (European Criminal Records Information System, Ecris), het Europees arrestatiebevel en het Europees onderzoeksbevel, te verbeteren en daarbij het evenredigheidsbeginsel en de grondrechten te eerbiedigen; verzoekt de lidstaten snel akkoord te gaan met alle maatregelen die in het kader van de routekaart inzake procedurele rechten voorgesteld zijn en in een volgend stadium knopen door te hakken met betrekking tot voorlopige hechtenis en detentievoorwaarden;
21. engage les États membres à intensifier la coopération judiciaire entre eux à partir des instruments existants de l'Union, comme le système européen d'information sur les casiers judiciaires, le mandat d'arrêt européen et la décision d'enquête européenne, dans le respect de la proportionnalité et des droits fondamentaux; invite les États membres à approuver promptement toutes les mesures proposées, dans l'esprit de la feuille de route sur les droits procéduraux, puis à prendre, dans un deuxième temps, des décisions concernant la détention provisoire et les conditions carcérales;

22. verzoekt de lidstaten de justitiële samenwerking middels de beschikbare EU-instrumenten, zoals het Europees Strafregisterinformatiesysteem (European Criminal Records Information System, Ecris), het Europees arrestatiebevel en het Europees onderzoeksbevel, te verbeteren en daarbij het evenredigheidsbeginsel en de grondrechten te eerbiedigen; verzoekt de lidstaten snel akkoord te gaan met alle maatregelen die in het kader van de routekaart inzake procedurele rechten voorgesteld zijn en in een volgend stadium knopen door te hakken met betrekking tot voorlopige hechtenis en detentievoorwaarden;
22. engage les États membres à intensifier leur coopération judiciaire mutuelle sur la base des instruments existants de l'Union, comme le système européen d'information sur les casiers judiciaires (ECRIS), le mandat d'arrêt européen et la décision d'enquête européenne, dans le respect de la proportionnalité et des droits fondamentaux; invite les États membres à approuver promptement toutes les mesures proposées, en accord avec la feuille de route sur les droits procéduraux, et à prendre ensuite des décisions concernant la détention provisoire et les conditions carcérales;

Selon le texte de cette loi : « The collected, processed and communicated criminal information subject to protection as set forth in the Act of 22 January 1999 on protection of secret information».

Tenslotte wordt het doorgeven van informatie naar andere landen beheerst door de bepaling : « Communication of criminal information is subject to the consent of the obligated subject which has communicated the information or the result of a ratified international agreement».
