2. De bepalingen van de te Pretoria op 11 oktober 1999 ondertekende bilaterale overeenkomst inzake handel, ontwikkeling en samenwerking tussen de Europese Gemeenschap, haar lidstaten en Zuid-Afrika, hierna de « TDCA » (Trade and Development Co-operation Agreement between the European Community, its Member States and South Africa) genoemd, prevaleren boven de bepalingen van deze Overeenkomst.
2. Les dispositions de l'accord bilatéral sur le commerce, le développement et la coopération entre la Communauté européenne, ses États membres et l'Afrique du Sud signé à Pretoria le 11 octobre 1999, ci-après dénommé « ACDC », prévalent sur les dispositions du présent accord.

Overeenkomstig artikel 14, lid 2, onder 6), van de meerjarige overeenkomst voor de financiering dienen deze regels in overeenstemming te zijn met de regelgeving in het handboek van de Commissie genaamd "Service, Supply, and Work Contracts concluded within the Framework of Community Co-operation for the Third Countries".
Conformément à l'article 14, paragraphe 2, alinéa 6, de la convention pluriannuelle de financement, ces règles doivent être cohérentes avec les règles édictées dans le manuel de la Commission intitulé « Marchés de fournitures, de travaux et de services conclus dans le cadre de la coopération communautaire pour les pays tiers ».

As stated in the June 2003 conclusions of the European Council (Greek Presidency), and following the war, the adoption of UNSC Resolution 1483 demonstrates a new spirit of co-operation within the international community and provides the basis for effective international support for Iraq's political transition as the international community is facing the emergency of actively supporting the restoration of political authority in the failed state of Iraq - where increased insecurity, acts of terrorism and violations of human rihgts have been constant over the last months, leaving behind thousands of casualties, both military and civilians- and of fostering economic and social prosperity in a deliquescent Iraqi society.
