Het voorgestelde artikel 1147ter , tiende lid, van het Gerechtelijk Wetboek bepaalt weliswaar dat het uitleggingsarrest geen bindende kracht heeft, maar « au-delà des apparences » moet men vaststellen dat dit arrest erga omnes zal gelden zodat het Hof van Cassatie zich op het exclusieve bevoegdheidsdomein van de wetgever begeeft.
