G. overwegende dat de toestand juridisch ingewikkeld werd toen de VS op 3 augustus 2007 met de vaststelling van afdeling 711 van de "Secure Travel and Counterterrorism Partnership Act of 2007" (Implementing Recommendations of the 9/11 Commission Act of 2007) hun regeling van ontslag van visumplicht herzagen door zeven veiligheidsverbeteringen in te voeren zodat alle lidstaten die deel wensen te nemen aan het programma voor ontslag van visumplicht moesten instemmen met de ondertekening van een bilaterale gemeenschappelijke intentieverklaring en de daarbij behorende bindende "uitvoeringsvoorschriften";
