Overeenkomstig de wet van 21 augustus 2008 houdende oprichting en organisatie van het e-Health-platform heeft het e-Health-platform tien wettelijke opdrachten, waaronder:

8° het, als intermediaire organisatie, zoals gedefinieerd krachtens de Wet van 8 december 1992 tot bescherming van de persoonlijke levenssfeer ten opzichte van de verwerking van persoonsgegevens, inzamelen, samenvoegen, coderen of anonimiseren, en ter beschikking stellen van gegevens nuttig voor de kennis, de conceptie, het beheer en de verstrekking van gezondheidszorg; het e-Health-platform zelf mag de in het kader van deze opdracht verwerkte persoonsgegevens slechts bijhouden zolang dat noodzakelijk is om ze te coderen of te anonimiseren; het e-Health-platform mag evenwel het verband tussen het reële identificatienummer van een betrokkene en het aan hem toegekend gecodeerd identificatienummer bijhouden indien de bestemmeling van de gecodeerde persoonsgegevens daarom op een gemotiveerde wijze verzoekt, mits machtiging van de afdeling gezondheid van het sectoraal comité van de sociale zekerheid en van de gezondheid; het e-Health-platform kan deze opdracht slechts vervullen op vraag van een wetgevende kamer, een instelling van sociale zekerheid, de stichting bedoeld in artikel 45quinquies van het Koninklijk besluit nr. 78 van 10 november 1967 betreffende de uitoefening van de gezondheidszorgberoepen, het Intermutualistisch Agentschap, het Federaal Kenniscentrum voor de Gezondheidszorg, de vereniging zonder winstoogmerk bedoeld in artikel 37, een federaal minister, een federale overheidsdienst of een openbare instelling met rechtspersoonlijkheid die onder de federale overheid ressorteert; de Koning kan, bij een besluit vastgesteld na overleg in de Ministerraad en na advies van de Commissie voor de Bescherming van de Persoonlijke Levenssfeer en van het Beheerscomité, de lijst van de mogelijke instanties die het e-Health-platform kunnen vragen om als intermediaire organisatie op te treden, uitbreiden
8° en tant qu'organisme intermédiaire, tel que défini en vertu de la loi du 8 décembre 1992 relative à la protection de la vie privée à l'égard des traitements de données à caractère personnel, recueillir, agréger, coder ou anonymiser et mettre à disposition des données utiles à la connaissance, à la conception, à la gestion et à la prestation de soins de santé; la plate-forme eHealth ne pourra conserver les données à caractère personnel traitées dans le cadre de cette mission que pour la durée nécessaire à leur codification ou anonymisation; la plate-forme eHealth peut cependant conserver le lien entre le numéro d'identification réel d'une personne concernée et le numéro d'identification codé qui lui a été attribué, si le destinataire des données à caractère personnel codées en fait la demande d'une façon motivée, moyennant une autorisation de la section santé du comité sectoriel de la sécurité sociale et de la santé; la plate-forme eHealth peut uniquement réaliser cette mission à la demande d'une chambre législative, d'une institution de sécurité sociale, de la fondation visée à l'article 45quinquies de l'arrêté royal n° 78 du 10 novembre 1967 relatif à l'exercice des professions de soins de santé, de l'Agence intermutualiste, du Centre fédéral d'expertise des soins de santé, de l'association sans but lucratif visée à l'article 37, d'un ministre fédéral, d'un service public fédéral ou d'une institution publique dotée de la personnalité juridique qui relève des autorités fédérales; le Roi peut, par arrêté délibéré en Conseil des Ministres et après avis de la Commission de la protection de la vie privée et du Comité de gestion, élargir la liste des instances qui peuvent faire appel à la plate-forme eHealth comme organisation intermédiaire

“De Koning kan, bij besluit vastgesteld na overleg in de Ministerraad, na advies van het Beheerscomité en na advies van de Commissie voor de Bescherming van de Persoonlijke Levenssfeer, bepalen welke gegevens door welke overheidsinstellingen aan het e-Health-platform verplicht en elektronisch worden meegedeeld voor de uitvoering van zijn opdrachten, en welke gegevens het e-Health-platform aan welke overheidsinstellingen verplicht en elektronisch meedeelt voor de uitvoering van hun opdrachten”.
“Le Roi peut par arrêté délibéré en Conseil des Ministres, après avis du Comité de gestion et après avis de la Commission de la protection de la vie privée, déterminer quelles données doivent obligatoirement être communiquées par quelles institutions publiques à la plate-forme eHealth, et ce par voie électronique, en vue de l'exécution des missions de cette dernière et quelles données doivent obligatoirement être communiquées par la plate-forme eHealth à quelles institutions publiques, et ce par voie électronique, pour l'exécution des missions de ces dernières”.

Bij de toetsing van het e-Health platform aan het recht op eerbiediging van het privéleven, moet worden nagegaan of het e-Health platform is voorgeschreven door een voldoende precieze wettelijke bepaling en of het noodzakelijk en evenredig is om een wettige doelstelling te bereiken.
En examinant la plate-forme eHealth sous l’angle du droit à la protection de la vie privée, il faut vérifier si la plate-forme eHealth est prescrite par une disposition légale suffisamment précise et si elle est nécessaire et proportionnelle pour poursuivre un objectif légitime.

Bijgevolg wordt aan de Koning de mogelijkheid geboden om overheidsinstellingen – dat zijn alle mogelijke administratieve overheden (overheidsdiensten, openbare instellingen, .), ongeacht hun overheidsniveau (federaal, gewestelijk, .) – bij besluit vastgesteld na overleg in de Ministerraad en na advies van het Beheerscomité van het e-Health-platform en van de Commissie voor de Bescherming van de Persoonlijke Levenssfeer te verplichten om bepaalde gegevens die door hen worden beheerd op elektronische wijze mee te delen aan het e-Health-platform, opdat dit laatste deze gegevens vervolgens verder zou kunnen overmaken aan andere bestemmelingen die ze nodig hebben voor het verrichten van hun taken.
Par conséquent, le Roi a la possibilité d'obliger les institutions publiques - c'est-à-dire tous les pouvoirs administratifs (services publics, institutions publiques, .), tous niveaux de pouvoir confondus (fédéral, régional, .) - par arrêté délibéré en Conseil des ministres et après avis du Comité de gestion de la plate-forme eHealth et de la Commission de la protection de la vie privée, à communiquer de façon électronique à la plate-forme eHealth certaines données dont ils assurent la gestion, de sorte que la plate-forme eHealth puisse transmettre ces données à d'autres destinataires qui en ont besoin pour la réalisation de leurs tâches.
