De aanhef van dezelfde richtlijn 93/42/EEG bepaalt echter in een vierde overweging “dat de geharmoniseerde bepalingen moeten worden onderscheiden van de maatregelen die de lidstaten treffen voor het beheren van de financiële middelen voor de volksgezondheids- en ziektekostenverzekeringsstelsels die direct of indirect betrekking hebben op dergelijke hulpmiddelen; dat bijgevolg deze bepalingen de mogelijkheid voor de lidstaten om, met inachtneming van het Gemeenschapsrecht, bovengenoemde maatregelen ten uitvoer te leggen, onverlet laten”.
Le préambule de la même directive 93/42/CEE énonce toutefois en un quatrième considérant « que les dispositions harmonisées doivent être distinguées des mesures prises par les Etats membres en vue de gérer le financement des systèmes de santé publique et d’assurance maladie concernant directement ou indirectement de tels dispositifs; que, dès lors, ces dispositions n’affectent pas la faculté des Etats membres de mettre en œuvre les mesures susmentionnées dans le respect du droit communautaire ».
