Artikel 5 van de richtlijn 98/8/EG bepaalt onder de voorwaarden voor de verlening van toelating, in punt 2: “Een biocide dat overeenkomstig artikel 20, lid 1, als vergiftig, zeer vergiftig, kankerverwekkend of mutageen categorie 1 of 2, of als vergiftig voor de voortplanting categorie 1 of 2 is ingedeeld, wordt niet toegelaten voor de verkoop aan of het gebruik door het grote publiek”.
La directive 98/8/CE prévoit , à l’article 5, dans les conditions d’octroi d’une autorisation, au point 2, que : « un produit biocide classé, en vertu de l'article 20, paragraphe 1, comme toxique, très toxique ou comme cancérigène en catégorie 1 ou 2, ou mutagène en catégorie 1 ou 2, ou comme toxique pour la reproduction en catégorie 1 ou 2, n'est pas autorisé en vue de sa commercialisation auprès du grand public ou de son utilisation par celui-ci ».
