Omschrijving: Een toestand van tot stilstand gekomen of onvolledige ontwikkeling van het verstand, die vooral wordt gekenmerkt door een tijdens de ontwikkelingsperiode aan het licht tredende stoornis van vaardigheden, die mede bepalend is voor het algehele intelligentieniveau, d.w.z. cognitieve, verbale, motorische en sociale vermogens. Het is gebruikelijk de graad van zwakzinnigheid te schatten aan de hand van gestandaardiseerde intelligentietests. Deze kunnen worden aangevuld met schaalindelingen die de sociale aanpassing onder gegeven omstandigheden bepalen. Deze metingen geven een benadering van de graad van zwakzinnigheid. De diagnose zal ook afhankelijk zijn van de algehele beoordeling van het verstandelijk functioneren door een ervaren diagnosticus. Verstandelijke vermogens en sociale aanpassing kunnen in de loop van de tijd veranderen en, hoe gering ze ook zijn, verbeteren als resultaat van training en revalidatie. De diagnose dient gebaseerd te zijn op het huidige niveau van functioneren.

Retardation can occur with or without any other mental or physical condition. Degrees of mental retardation are conventionally estimated by standardized intelligence tests. These can be supplemented by scales assessing social adaptation in a given environment. These measures provide an approximate indication of the degree of mental retardation. The diagnosis will also depend on the overall assessment of intellectual functioning by a skilled diagnostician. Intellectual abilities and social adaptation may change over time, and, however poor, may improve as a result of training and rehabilitation. Diagnosis should be based on the current levels of functioning.

Zelfs al is het Parlement er tijdens de trialoogonderhandelingen niet in geslaagd de Raad ervan te overtuigen een mechanisme op te nemen om niet-vastgelegde financiële middelen toe te wijzen aan energie-efficiëntie en hernieuwbare energiebronnen, heeft de Commissie het standpunt van het Parlement toch meegenomen in een aan de definitieve verordening gehechte verklaring om in overweging te nemen financiële middelen die eind 2010 niet zijn vastgelegd te gebruiken voor projecten op het gebied van energie-efficiëntie en hernieuwbare energiebronnen: "Indien de Commissie, bij de rapportage over de uitvoering van de verordening in 2010 conform artikel 28 daarvan, constateert dat een deel van de middelen voor de in de bijlage bij de verordening vermelde projecten niet tegen eind 2010 zal kunnen worden vastgelegd, dan stelt zij in voorkomend geval een geografisch evenwichtige wijziging van de verordening voor, zodat naast de bovengenoemde initiatieven ook projecten op het gebied van energie-efficiëntie en hernieuwbare energiebronnen kunnen worden gefinancierd, mede aan de hand van soortgelijke subsidiabiliteitscriteria als die voor de projecten welke staan vermeld in de bijlage bij deze verordening".
Even thought the Parliament did not succeed in convincing the Council in the trilogue negotiations to include a mechanism to allocate un-committed funds to energy efficiency and renewable sources of energy, the Commission took the Parliament's view on board by making a declaration attached to the final regulation to consider using any funds unspent by the end of 2010 for energy efficiency and renewable projects: "Should the Commission, when reporting in 2010 on the implementation of the Regulation under its Article 28, find that it will not be possible to commit by the end of 2010 a part of the funds foreseen for the projects listed in the annex to the Regulation, the Commission will propose, if appropriate and in a geographically balanced way, an amendment to the Regulation allowing for the financing of projects in the area of energy efficiency and renewable energy sources, in addition to the above initiatives, including eligibility criteria similar to those applying to projects listed in the Annex to this Regulation".
