Deze verordening respecteert de grondrechten en neemt de beginselen die met name in het Handvest van de grondrechten van de Europese Unie zijn erkend, in acht, in het bijzonder het recht op de bescherming van persoonsgegevens (artikel 8), de vrijheid van ondernemerschap (artikel 16), het recht op consumentenbescherming (artikel 38), het recht op een doeltreffende voorziening in rechte en op een onpartijdig gerecht (artikel 47) en het recht om niet tweemaal voor hetzelfde delict te worden berecht of gestraft (artikel 50), en moet worden toegepast in overeenstemming met deze rechten en beginselen.
This Regulation respects the fundamental rights and observes the principles recognised in particular by the Charter of Fundamental Rights of the European Union, in particular the right to the protection of personal data (Article 8), the freedom to conduct a business (Article 16), the right to consumer protection (Article 38), the right to an effective remedy and to a fair trial (Article 47), and the right not to be tried or punished twice for the same offence (Article 50), and has to be applied in accordance with those rights and principles.

(26) This Directive respects fundamental rights and observes the principles recognised in particular by the Charter of Fundamental Rights of the European Union and notably the right to liberty and security, the respect for private and family life, the freedom to choose an occupation and right to engage in work, the freedom to conduct a business, the right to property, the right to an effective remedy and to a fair trial, the presumption of innocence and the right to defence, the principles of the legality and proportionality of criminal offences and penalties, as well as the prohibition of being tried or punished twice in criminal proceedings for the same criminal offence.
