At the time, the Governing Council took into consideration the fact that the Hellenic Republic had approved a programme which the Governing Council considered to be appropriate so that, from a credit risk management perspective, the marketable debt instruments issued or guaranteed by the Hellenic Republic retained a quality standard sufficient for their continued eligibility as collateral for Eurosystem monetary policy operations, irrespective of any external credit assessment.

Met betrekking tot de financiële correcties die zijn opgelegd bij het bestreden uitvoeringsbesluit van de Commissie van 2 mei 2013 houdende onttrekking aan EU-financiering van bepaalde uitgaven die de lidstaten hebben verricht in het kader van het Europees Oriëntatie- en Garantiefonds voor de Landbouw (EOGFL), afdeling Garantie, in het kader van het Europees Landbouwgarantiefonds (ELGF) of in het kader van het Europees Landbouwfonds voor plattelandsontwikkeling (Elfpo) [Kennisgeving geschied onder nummer C(2013) 2436] (PB L 123, blz. 11), voor zover het de Helleense Republiek een financiële correctie oplegt van in totaal 6 175 094,49 EUR voor uitgaven die zij heeft gedaan in het kader van het Europees Landbouwfonds voor plattelandsontwikkeling, as 2, 2007-13, oppervlaktegebonden maatregelen in de boekjaren 2009 en 2010 (aanvraagjaren 2008 en 2009), voert de Helleense Republiek de volgende gronden voor nietigverklaring aan.
In relation to the financial corrections imposed by the contested Commission implementing decision of 2 May 2013 on excluding from European Union financing certain expenditure incurred by the Member States under the Guarantee Section of the European Agricultural Guidance and Guarantee Fund (EAGGF), the European Agricultural Guarantee Fund (EAGF) and the European Agricultural Fund for Rural Development (EAFRD), notified under document C(2013) 2436 and published at OJ 2013 L 123, in so far as that decision imposes on the Hellenic Republic a financial correction totalling EUR 6 175 094,49 for expenditure incurred by it within the framework of the European Agricultural Fund for Rural Development, in Axis 2, 2007-13, area related measures in the financial years 2009 and 2010 (claim years 2008 and 2009), the Hellenic Republic puts forward the following pleas for annulment:

1. 1. The use, as collateral for Eurosystem credit operations, of marketable debt instruments issued or fully guaranteed by the Hellenic Republic that do not fulfil the Eurosystem’s minimum requirements for credit quality thresholds, as specified in the Eurosystem credit assessment framework rules for certain marketable assets in Section 6.3.2 of Annex I to Guideline ECB/2011/14 while fulfilling the other eligibility requirements specified in Annex I to Guideline ECB/2011/14, shall be conditional on the provision by the Hellenic Republic to NCBs of a collateral enhancement in form of a buy-back scheme.

Reference is made to a loan facility agreement (hereinafter the Loan Facility Agreement) between the Member States whose currency is the euro (other than the Hellenic Republic and the Federal Republic of Germany) and KfW acting in the public interest, subject to the instructions of and with the benefit of the guarantee of the Federal Republic of Germany (hereinafter the Lenders) with the Hellenic Republic (hereinafter the Borrower) and the Bank of Greece as agent to the Borrower.
